selling cement products with unqualified net content violates Article 9 of the Measures for the Measurement Supervision and Administration of Quantitatively Packaged Commodities, which stipulates that the average actual content of quantitatively packaged commodities in batches shall be greater than or equal to the marked net content. If the method of
sampling is used to evaluate an inspection lot of quantitatively packed commodities, the sampling inspection and calculation shall be carried out in accordance with the provisions of Schedule 4 of these Measures. The number of samples in which the difference between the marked net content and the actual content of a single quantitatively packed commodity in the sample is greater than allowable shortage and the average actual content of the sample shall conform to the provisions of Schedule 4 of these Measures.
According to Article 18 of the Measures for the Metrological Supervision and Administration of Quantitatively Packaged Commodities, "If a quantitatively packaged commodity produced or sold violates the provisions of Article 9 of these Measures after inspection, it shall be ordered to make corrections, and a fine of less than three times the value of the inspection batch may be imposed, with a maximum of 30000 yuan." The party concerned shall be ordered to correct the illegal act and shall be fined not more than three times the value of the inspection batch and not more than 30000 yuan.
