Reporters learned from Foshan Water Conservancy Bureau on May 23 that the "Reward Measures for Reporting Illegal Sand Mining and Transportation in Foshan City" (hereinafter referred to as "Measures") was issued on May 20 to further standardize the handling of rewards for reporting illegal sand mining and transportation.
Foshan is located in the lower reaches of Xijiang River and Beijiang River, and is the only place for sand and gravel shipping in Xijiang River and Beijiang River. In 2011, Foshan formally implemented the Interim Measures for Rewarding the Public for Reporting Illegal Sand Mining Activities in Foshan City, and in 2018, the Measures for Rewarding the Public for Reporting Illegal Sand Mining and Transportation Activities were implemented to encourage the public to actively participate in the supervision of water law enforcement, report illegal sand mining and transportation activities, and play a greater role in ensuring the safety of river flood control, shipping and water supply.
After this revision, the connotation of sand mining and transportation has been updated in the Measures.
Among them, illegal sand mining mainly includes sand mining without a river sand mining permit, sand mining not in accordance with the provisions of the river sand mining permit, sand mining during the prohibited period and the prohibited period of sand mining operations, and sand mining without a river sand mining permit; There are four situations in which sand mining operations are carried out outside the scope of engineering plane control and elevation control stipulated in the approved scheme, or the river sand mined is not disposed of in accordance with the approved scheme.
Illegal sand transportation mainly includes the transportation of river sand without the legal source certificate of river sand within the scope of river management, the transportation of river sand with the legal source certificate of river sand exceeding the number of valid times or the validity period, the forgery and alteration of the legal source certificate of river sand, and the illegal transfer of the legal source certificate of river sand by means of sale, lease and lending; The quantity carried obviously does not conform to the five situations recorded in the legal source certificate of river sand.
In order to effectively enhance the enthusiasm of the public to participate in reporting, the reward range of administrative penalties for fines in the Measures has been doubled, and the reward has been adjusted to 20%, 16% and 12% of the amount of fines; the reward for administrative penalties for non-fines has been unified as 1000 yuan.
According to different reward levels and different reward situations, the amount of bonus for reporting illegal sand mining and transportation shall be calculated in different ways.
Firstly, according to the completeness of the content of the report and its consistency with the illegal facts, the reward is divided into three levels, the highest level is the first level.
Secondly, different bonus calculation methods are applicable to the following three situations: if the case is verified and a fine is imposed on the offender, a reward of 20%, 16% and 12% of the amount of the fine shall be given respectively according to the reward level (from the first level to the third level), and the total amount of the reward shall be limited to 100,000 yuan; If the case is verified to be true and the offender is not fined, a reward of 1,000 yuan will be given; if the offender is suspected of committing a crime and is transferred to the judicial organ, the judicial organ has investigated the criminal responsibility of the offender and no longer investigates the administrative responsibility, a reward ranging from 20,000 yuan to 100,000 yuan will be given to the informer.
In order to better protect the identity information of informants, the Measures stipulate that the reporting materials and related files shall be kept by the staff receiving the reports. After the reward for reporting is completed, the staff receiving the report shall, within five working days, seal the materials related to the identity information of the informer, such as the Information Registration Form of the Informer, in an envelope and sign them at the seam of the seal, and hand them over to the confidential room.
