Recently, Yangjiang, Guangdong Province, issued the "Opinions on the Implementation of Strengthening the Management of River Sand Mining" (hereinafter referred to as "Opinions") to comprehensively consolidate the responsibility of river sand mining management, rationally utilize river sand resources, protect the ecological environment, and ensure the safety of flood control, water supply, water engineering and shipping.
The Opinion points out that the management of sand mining in rivers should be carried out at different levels of responsibility and territorial management. The people's governments (administrative committees) of cities and counties (cities and districts) shall strengthen their leadership over the management of sand mining in rivers, incorporate the management of sand mining in rivers into the work of river length system, establish a system of supervision, notification, assessment and accountability for the management of sand mining in rivers, and improve the coordination mechanism for the management of sand mining in rivers. River chiefs at all levels are directly responsible for the management and protection of rivers and reservoirs under their jurisdiction, responsible for organizing and leading the management of sand mining in corresponding rivers and reservoirs, and taking the management of sand mining in rivers as an important part of the management and protection of rivers and reservoirs.
The Opinion clearly States that the river sand mining right in Yangjiang City is transferred by means of fair competition such as public bidding, and the comprehensive evaluation method is adopted in the evaluation of river sand mining right. In accordance with the principle of territorial management, the water administrative department at the county level, in conjunction with the relevant competent departments of the local town people's government (sub-district offices), natural resources, ecological environment, transportation, agriculture and rural areas, as well as maritime and waterway management agencies, delimits the annual river sand mining area according to the amount of sand coming from the river course, water regime and river regime, etc. In October of each year, the mineable and prohibited areas of river sand for the next year will be announced.
The Opinion points out that the county-level water administrative department and the town people's government (sub-district office) where the mining area is located employ on-site managers on duty 24 hours a day to supervise the amount of sand mining on that day and strengthen the on-site management of the mining area. The entrusted supervision unit shall supervise and manage the sand mining scope (including specific location, key coordinates, minimum control mining elevation, etc.), mining time, sand mining quantity, sand mining operation mode, name of operation tools and their power and quantity, and sand unloading point of the sand miner, and verify the publicity of the sand mining site.
The Opinion clearly States that the market shall determine the selling price of river sand, and the people's government at the county level where the mining area is located shall take relevant effective measures to promote fair competition in the sand and gravel market and prevent price monopoly. According to the principle of benefit sharing and responsibility sharing, the income from the transfer of river sand mining rights is mainly used for river sand mining management, river ecological environment management, river construction, maintenance and management, giving priority to the funds of town people's governments (sub-district offices), villagers'committees and residents' committees participating in river sand mining management. Rural villagers who need to excavate river sand with a total amount of less than 50 cubic meters for self-built houses may be exempted from applying for a river sand mining license and can only be exploited in the mineable areas established in their villages.
