Recently, the Ministry of Natural Resources and the Ministry of Finance jointly issued the Guiding Opinions on the Formulation of the Starting Price Standard for the Transfer of Mining Rights (hereinafter referred to as "Opinions"). The Opinion clarifies the starting price standard of non-oil and gas minerals (excluding rare earth and radioactive minerals) and the income from the transfer of mining rights of oil and gas minerals. Among them, the starting price standard (reference value) of mining rights transfer income of non-oil and gas minerals (excluding rare earth and radioactive minerals) is 20000 yuan per square kilometer.

The Opinion points out that the starting price standard for the transfer of mining rights of non-oil and gas minerals (excluding rare earth and radioactive minerals) is mainly based on the area of mining rights, taking into account factors such as metallogenic conditions and exploration degree. Provincial departments in charge of natural resources and financial departments may, in light of the actual situation in the region, adjust the starting price standard for the transfer of mining rights of non-oil and gas minerals (excluding rare earth and radioactive minerals), with the adjustment range not exceeding 10%.

The Opinions shall come into force on the date of issuance and shall be valid for five years. Some insiders pointed out that the publication of the Opinion may have an impact on the starting price of sand and gravel mines listed for sale in the future, and the specific impact still needs to be paid attention to. In accordance with the relevant provisions of the Circular of the Ministry of Finance, the Ministry of Natural Resources and the State Administration of Taxation on Printing and Distributing (Cai Zong [2023] No.10), the following guiding opinions are hereby put forward on the formulation of the starting price standard for the transfer income of mining rights.

1. The starting price standard for the transfer of mining rights of non-oil and gas minerals (excluding rare earth and radioactive minerals) is mainly based on the area of mining rights, taking into account the metallogenic conditions, exploration degree and other factors. Provincial natural resources authorities and financial departments may adjust the starting price standard (reference value) of mining rights transfer income on the basis of Annex 1 in light of the actual situation of the region, with the adjustment range not exceeding 10%. The specific implementation standards shall be published and implemented after being submitted to the provincial people's government for approval. After the standard is formulated, it will not be adjusted in principle. When formulating standards, all localities should give full consideration to promoting the active market for the transfer of exploration rights, lowering the threshold for the acquisition of exploration rights, and not linking them with resource reserves. The starting price standard for the transfer of mining rights of rare earth and radioactive minerals shall be implemented in accordance with Annex 1.

Starting price = starting price standard × adjustment coefficient of metallogenic geological conditions × adjustment coefficient of exploration work degree × mining right area.

2. The starting price standard for the transfer of mining rights of oil and gas minerals shall be implemented in accordance with Annex 2.

These Guiding Opinions shall come into force as of the date of issuance and shall be valid for five years.
