II. Accident process and emergency disposal

(1) The accident occurred

at about 09:30 on April 30, 2023. On the sawing process platform of Lantian Sand and Stone Yard of Xishuangbanna Wanfeng Building Materials Co., Ltd., Su Yunying drove a loader to cut the waste stone produced by the sawing operation. It was pushed from the notch of the working platform to the bottom of the steep slope of nearly 90 meters, and fell to the bottom of the slope together with the loader due to the improper operation of Su Yunying. After the accident, the nearby workers immediately reported to the safety officer, and the safety officer and the relevant responsible person immediately rushed to the scene for rescue. When they arrived at the scene, they found that Su Yunying had no vital signs.

3. Accident scene investigation and corpse identification conclusion

(I) Site investigation: According to the Record of Site Investigation (Jing Emergency Survey [2023] No.1), the investigation is as follows: 1. The accident site is located on the left side of the operation slope of Lantian Sand and Stone Yard, with a slope height of about 90 meters and a vertical wall; 2. There was a loader at the falling point on the bottom slope of the slope, which was seriously damaged and the body was seriously deformed; 3. A 1000x300 mm yellow iron sheet fell at about 10 meters on the upper right side of the loader, which was identified as the first falling point of the loader by the on-site personnel, and the deceased moved out from the point; 4. At about 9:30 on April 30, 2023, a person was driving a loader in Lantian Quarry of Xishuangbanna Wanfeng Building Materials Co., Ltd. in Manhaidamu, Manmian Community, Gasa Street, Jinghong City. The driver fell from the hillside with the loader and died of injury. After receiving the instructions, the police of Gasa Police Station of Jinghong Public Security Bureau arrived at the scene for investigation and disposal. After investigation, the deceased was Su Yunying. The technical police of Jinghong Public Security Judicial Appraisal Center in Yunnan Province arrived at the scene for investigation. According to the scene investigation and autopsy, combined with the investigation, Su Yunying was in line with the characteristics of high fall and extrusion injury.

4. Causes and nature

According to the relevant laws and regulations such as the Safety Production Law of the People's Republic of China, the investigation team, based on the investigation and verification of the accident and the analysis of the causes of the accident, determines that the following personnel and units shall bear the corresponding responsibilities. The following suggestions are put forward:

(1) Su Yunying (the deceased) did not have special technical training for operating loaders and was not familiar with the technical regulations for post operation, resulting in improper operation of loaders and falling into high and steep slopes, resulting in the accident. In violation of the provisions of Article 58 of the Production Safety Law of the People's Republic of China, he was directly responsible for the accident. In view of the death of Su Yunying, he was exempted from accountability.

(2) Wang Hongzhu, as the principal person in charge of Xishuangbanna Wanfeng Building Materials Co., Ltd., is not familiar with the safety production work of the unit, fails to perform the statutory duties of safety production, supervises and inspects the safety production work of the unit, and eliminates the hidden dangers of production safety accidents in time, resulting in accidents. His actions violated the provisions of Article 21, Items 3 and 5 of the Safety Production Law of the People's Republic of China, and he was responsible for the management of the accident. It is suggested that the Emergency Management Bureau of Jinghong City, in accordance with the provisions of Article 95, paragraph 1, of the Safety Production Law of the People's Republic of China, Wang Hongzhu was fined twenty-four thousand yuan (¥ 24,000).

(III) Xishuangbanna Wanfeng Building Materials Co., Ltd. failed to organize the establishment and implementation of the dual prevention mechanism of new process safety risk classification control and hidden danger investigation and management according to the statutory requirements, and took technical and management measures to timely detect and eliminate hidden dangers of accidents; Failure to comply with the provisions of Article 17 of the Regulations on Safety Training of Production and Business Units (Decree No.80 of the State Administration of Work Safety), failure to provide special safety technical training for employees by adopting new processes, and failure to master the operation skills of their posts, resulting in accidents. Safety warning signs have not been set up in production sites with greater risk factors. In violation of the provisions of Article 28, paragraph 1, Article 35 and Article 41, paragraph 2, of the Safety Production Law of the People's Republic of China, it is responsible for the management of the accident and should be investigated for responsibility. It is suggested that the Emergency Management Bureau of Jinghong City shall, in accordance with the provisions of Article 114, paragraph 1, of the Safety Production Law of the People's Republic of China. VI. Accident prevention and rectification measures

Fully fulfill the statutory responsibilities of safety production, organize the establishment and implementation of the dual prevention mechanism of new process safety risk classification control and hidden danger investigation and management, supervise and inspect the workplace, and timely detect and eliminate all kinds of potential safety hazards at the workplace; Effectively carry out safety production education and training, employees master their own knowledge of safety production, and master safety production skills skillfully. To avoid the recurrence of similar accidents.

(II) Relevant regulatory authorities urge Xishuangbanna Wanfeng Building Materials Co., Ltd. to implement the Report on Completion Acceptance of Safety Facilities for Lantian Sand and Gravel Yard (103,400m ³/a) Open-pit Mining Project of Xishuangbanna Wanfeng Building Materials Co., Ltd. 1. Set up a protective fence for the sawing process test platform, and set up a block at the entrance of the lower part of the high and steep slope in the test area to prohibit the entry of personnel and equipment; 2.
