Fake "Tianrui"! A cement enterprise was fined 180000 yuan
on August 14. Henan Provincial Market Supervision Bureau issued a typical case of "Iron Fist" action in the field of market supervision and people's livelihood in 2023 (4), which mentioned that Xinxiang Municipal Market Supervision Bureau investigated and dealt with the case of Xinxing Cement Plant infringing the exclusive right to use registered trademarks. On April 10,
2023, the Market Supervision Bureau of Xinxiang City inspected Xinxiang Xinxing Cement Plant according to the clues of the report, and found 4600 "Tianrui" brand cement bags stored in the warehouse. The trademark owner Tianrui Group Co., Ltd. confirmed that the above bags belonged to the products infringing the exclusive right to use registered trademarks.
After investigation, without the authorization and permission of the trademark registrant, the party concerned forged 7000 "Tianrui" brand cement packaging bags without authorization, with an illegal business volume of 26000 yuan. On May 26, 2023, the Market Supervision Bureau of Xinxiang City, in accordance with the provisions of Article 60 of the Trademark Law of the People's Republic of China, ordered the party concerned to stop the infringement and confiscated 4600 infringing cement packaging bags; A fine of 180000 yuan.
Shijiazhuang police cracked a fake cement case and arrested 19 people
at about 10 o'clock on August 5. Through collecting fixed evidence, arranging visits, in-depth analysis, meticulous research and judgment, the police finally determined that the production and sale of counterfeit registered trademark brand cement products nest is located in Niucheng Town, Lingshou County. At about 8 o'clock
on August 8, the Food and Drug Brigade of the Joint Bureau of the Institute launched a rapid attack on suspected illegal production and sale of counterfeit cement products in a village in Niucheng Town, Lingshou County. 146 counterfeit registered trademark packaging bags of Shijiazhuang Cement Co., Ltd. were seized on the spot, and 19 suspects such as Cui Mouhui were arrested.
After interrogation, 19 suspects, including Cui Mouhui (male, 47 years old, Lingshou County), confessed to the crime of illegally producing and selling more than 500000 yuan of cement with the registered trademark of Shijiazhuang Cement Co., Ltd. since this year. At present, the above 19 suspects have been taken criminal compulsory measures according to law, and the case is under further trial.
On April 26, the Hunan Provincial Public Security Department announced a number of typical cases of cracking down on crimes of infringing intellectual property rights. Changsha public security organs cracked a series of cases of manufacturing and selling counterfeit brand cement. From January
2022 to March 2023, the public security organs of Ningxiang, Changsha, cracked a series of cases of counterfeit brand cement, organized several network collection operations, arrested 25 suspects, destroyed 6 production, processing and storage sites of counterfeit cement, seized 50 tons of counterfeit brand cement and 26000 counterfeit cement packaging bags on the spot, and seized the counterfeit brand cement. The products flowed into Guizhou, Hubei, Jiangxi, Hunan and other places, involving housing construction projects, water conservancy projects, real estate ancillary projects, slope protection projects and other construction projects. 2022, Beiguan Branch of Dongtai City, Yancheng City, Jiangsu Province, received a report from the public that a building material shopping mall in Dongtai City was selling counterfeit "Leida" trademark "Shanzhai Cement". Law enforcement officers found 238 bags of cement printed with the words "Leida" on the spot, totaling 11.9 tons. In January
2022, the West Lake Public Security Bureau of Hangzhou, Zhejiang Province, launched a centralized network collection operation, destroying 18 manufacturing and selling sites, 2 packaging warehouses, seizing 880000 cement packaging materials with counterfeit registered trademarks, and sealing up 22 cement tanks. Criminal compulsory measures have been taken against 63 suspects. At present, it has been verified that 300000 tons of counterfeit brand cement have been sold, involving more than 100 million yuan.
