In order to implement the Notice of the Department of Natural Resources of Zhejiang Province on Several Policies and Measures for Strengthening the Guarantee of Natural Resources Elements and Promoting the Steady Progress and Quality Improvement of the Economy (ZZZG [2023] No.2), The following requirements are put forward for the guarantee of mineral resources elements:
1. Do a good job in the guarantee
of mineral resources for major industrial projects and do a good job in the service of major industrial projects. For the major industrial projects jointly issued by the Provincial Development and Reform Commission and the Provincial Department of Natural Resources, due to the large demand for building stones in the infrastructure construction of the projects, If it is necessary to establish new mining rights for large-scale building stones, priority shall be given to the establishment of mining rights. The transfer of mining rights is not restricted by the annual transfer plan, and if the planning indicators of mining rights in the cities and counties where they are located are insufficient, they may be arranged in the reserved indicators of provincial mineral resources planning.
2. Orderly release of construction stone mining
rights in accordance with the Ministry of Industry and Information Technology and other ten ministries and commissions "Several Opinions on Promoting the High-quality Development of the Mechanism Sand and Stone Industry" (Ministry of Industry and Information Technology Lianyuan [2019] 239), The Guiding Opinions on Promoting the Healthy and Orderly Development of the Sandstone Industry (FGJG [2020] No.473) issued by the National Development and Reform Commission (NDRC) and other 15 departments require that the mining rights of large-scale building stones be supported, the construction and production of mechanism-driven sandstone enterprises be accelerated, and the construction of major industrial projects be guaranteed.
3. To coordinate the establishment
of mining rights across administrative regions, the competent department of natural resources at a higher level shall summarize the opinions of all parties, plan as a whole and formulate an overall plan. According to the overall plan, the competent departments of natural resources of relevant cities and counties (cities and districts) shall request the local government to coordinate the relevant departments to unify their ideas, fulfill their responsibilities, carry out the demonstration of the scope of mining areas and joint reconnaissance, and jointly promote the establishment of mining rights. According to the objectives set by the overall plan, if it is really difficult and difficult to achieve in one step, it can be implemented step by step. The registration of the transfer of mining rights shall be designated by the competent department of natural resources at the next higher level.
4. Implementing the policy
of phased payment of transfer income and implementing the provisions of phased payment of transfer income of mining rights, the requirements for phased payment of newly transferred mining rights shall be implemented in accordance with the Circular of the General Administration of Taxation of the Ministry of Finance, Ministry of Natural Resources, on the Issuance of the Measures for Collection of Transfer Income of Mining Rights (Finance Comprehensive No.2023). The period and amount of payment in installments shall be specified in the transfer announcement and contract.
5. Establish a responsibility mechanism
for construction projects, conscientiously implement the spirit of the Notice on Implementing Measures to Stabilize the Economy and Doing a Good Job in Excavating Sand and Gravel for Construction Projects (Zhejiang Natural Capital Development [2022] 8), and request the local government to establish "who is responsible for construction" and "who is responsible for construction" and "who is responsible for construction". According to the responsibility mechanism of "who supervises", the competent departments of construction projects should take full account of the original geographical and geomorphological characteristics, and reasonably determine the scale of sand, stone and soil excavation for construction projects based on the principle that the balance of self-use does not flow into the market.
