Article 2 [Scope of Application] These Regulations shall apply to the investigation, planning, construction, utilization, storage and management of new energy within the administrative region of the province. The term "new energy" as mentioned in

these Regulations refers to non-fossil energy such as wind energy, solar energy, biomass energy, geothermal energy, hydrogen energy and nuclear energy. Article

3 [Basic Principles] The development of new energy should be guided by Xi Jinping's thought of ecological civilization, adhere to ecological priority, follow the principles of adapting measures to local conditions, overall planning, systematic convergence and comprehensive utilization, and build a new energy system with clean, low-carbon, safe, efficient and multi-support. Article

4 [Participants] All kinds of market participants are encouraged to participate in the development and utilization of new energy, and the legitimate rights and interests of new energy developers and users are protected according to law. Article

5 [Responsibilities of the Government] People's governments at or above the county level shall strengthen their leadership over the development of new energy sources, incorporate the development of new energy sources into national economic and social development plans, formulate policies and measures to promote the development of new energy sources, establish and improve coordination mechanisms for the development of new energy sources, coordinate and solve major problems in the work, and promote the development of new energy sources. 7 [Publicity and Guidance] People's governments at all levels and relevant departments shall strengthen the publicity and education of new energy, popularize relevant knowledge of green and low-carbon energy development, energy conservation and green energy consumption, and guide the whole society to establish the concept of green and low-carbon life. Article

8 [Regional Coordination] The province shall strengthen communication and cooperation with Beijing, Tianjin and other regions in the field of new energy development, promote the interconnection of energy infrastructure, optimize the coordinated dispatch mechanism of power operation, increase the scale of new energy transmission and absorption across provinces and regions, enhance the mutual aid capacity of energy resources between provinces, and strengthen new energy science and technology. II Development Planning

Article 9 [Investigation of New Energy] The competent energy departments of the people's governments of provinces and cities with districts shall be responsible for organizing and coordinating the investigation of new energy resources in their respective administrative regions. The relevant departments of natural resources, water administration, agriculture, rural areas and meteorology of the provincial and district-based municipal people's governments shall be responsible for the investigation of relevant new energy resources within their respective responsibilities, and shall report the results of the investigation to the competent energy departments of the people's governments at the same level for summary. The investigation results of new energy resources in cities with districts shall be reported to the competent energy department of the provincial people's government for summary. 10 [New Energy Statistics] The competent statistical departments of the people's governments at or above the county level shall, in conjunction with the competent energy departments and other relevant departments and institutions, improve the statistical index system and statistical methods related to new energy in accordance with the relevant provisions of the state and the province, so as to ensure the authenticity, completeness and accuracy of statistical data.Article

11 [Planning Responsibilities] The competent energy department of the provincial people's government shall organize and coordinate the formulation of relevant plans for the development of new energy in the whole province in accordance with the provincial energy development plan. The competent energy department of the municipal people's government

with districts shall, in accordance with the relevant plans for the development of new energy in the whole province and in light of local conditions, organize the preparation of relevant plans for the development of new energy in its administrative region, which shall be submitted to the competent energy department of the provincial people's government for the record after approval by the people's government at the corresponding level. The competent energy department of the people's government

at the county level may organize and coordinate the preparation of relevant plans for the development of new energy in its administrative region according to its needs, and submit them to the competent energy department of the municipal people's government with districts for the record after approval by the people's government at the corresponding level.

The approved plan shall be made public, except for the contents that need to be kept confidential as stipulated by the state. Article

12 The formulation of relevant plans for the development of new energy sources shall follow the principles of scientific layout, step-by-step implementation, orderly development, innovative guidance, diversified coordination, green and efficient development, and make overall arrangements for the development and utilization of new energy sources such as wind energy, solar energy, biomass energy, geothermal energy, hydrogen energy and nuclear energy. Relying on the regional advantages and resource endowments of northern Hebei, central and southern Hebei, Taihang Mountains and coastal areas, the new energy industry will be developed. Relevant plans for

new energy development should include development types, objectives, layout, key projects, industrial support, service system and safeguard measures. Article

13 [Planning Connection] Plans related to new energy development shall be incorporated into territorial spatial planning, conform to ecological environment protection planning, and be connected with special plans such as power planning and power grid planning. Article

14 [Planning Demonstration] The formulation of relevant plans for the development of new energy shall seek the opinions of relevant units, experts and the public for scientific demonstration. Article

15 [Assessment and Change] The relevant planning departments for new energy development shall regularly organize and carry out the assessment of the implementation of the relevant planning for new energy development, and if it is really necessary to revise the planning according to the assessment results, it shall be handled in accordance with the original procedures. Article

16 [Science and Technology Development Planning] Departments of science and technology, development and reform of provincial and district-based municipal people's governments shall incorporate scientific and technological research and industrial development of new energy development and utilization into science and technology development planning and strategic emerging industry development planning, and list them as priority areas for science and technology development and strategic emerging industry development. III Development and Construction

Article 17 [General Requirements] People's governments at or above the county level shall, in accordance with the relevant plans for the development of new energy, determine the key areas for the development of new energy in their respective administrative regions according to local conditions, and develop new energy resources in a rational and orderly manner. 18 [Construction Requirements] The development and construction of new energy sources shall make good preparations for site selection, resource assessment, demonstration of construction conditions and market demand analysis, and meet the requirements of land use, sea use, forest use, grass use, river, lake and wetland management, and ecological environment protection. Article

19 [Centralized Wind Power and Photovoltaic] The competent energy department of the provincial people's government shall make overall plans for wind and solar energy resources, formulate and organize the implementation of the development and construction plans for centralized wind and photovoltaic power generation in accordance with the relevant plans for the development of new energy in the province, and promote the large-scale and base-based development of areas rich in wind and solar energy resources. In areas rich in solar energy resources, innovative development modes are

encouraged, and special photovoltaic power generation development modes such as agricultural light, forest light, animal husbandry light and fishing-light complementarity are adopted, or photovoltaic power generation projects are developed in combination with mine restoration and ecological restoration. 22 [Biomass Energy] Livestock and poultry farms, livestock and poultry slaughterhouses, breweries, etc. are encouraged to use biomass resources such as livestock and poultry manure, crop straw and other wastes to produce biogas cleanly and efficiently, and to support the industrialization of biogas.

Encourage the production and utilization of biomass fuels, develop the co-production of biomass heat, electricity and fertilizer, improve the level of straw energy utilization, and promote the diversified utilization of biomass energy.

Encourage the use of clean and environmentally friendly advanced power generation technology to treat urban and rural domestic waste, so as to realize waste reduction, resource utilization and harmlessness. Article

23 [Nuclear Energy] Promote the safe and effective use of nuclear energy, steadily promote the construction of nuclear power plants, and encourage the comprehensive use of nuclear energy such as nuclear heating and nuclear hydrogen production. Article

24 [Management of Wind Power and Photovoltaic Power Transmission] Power grid enterprises shall strengthen the construction of new energy transmission projects, rationally arrange the construction schedule, ensure that the transmission projects match the progress of power supply construction, and ensure that wind power and photovoltaic power generation projects are connected to the grid in time. New energy delivery projects that do not match the planning and construction sequence of

power grid enterprises can be invested and constructed by power generation enterprises. After completion, the power grid enterprise and the power generation enterprise may repurchase the power grid enterprise in accordance with the law and regulations by consensus.Article

25 The competent energy departments of the provincial people's governments shall make overall plans for the construction of new energy storage projects, such as electrochemical energy storage, mechanical energy storage, electromagnetic energy storage, hydrogen storage and heat (cold) storage, so as to promote the large-scale application of new energy storage, support the participation of social resources in the construction of new energy storage, and guide new energy power stations to allocate new energy storage in a market-oriented manner. 26 The competent energy departments of the people's governments at or above the county level shall take full account of the development scale of regional wind and photovoltaic power generation, the peak shaving demand of the power system, the resource conditions of the site and the economy of the project, improve the price formation mechanism of pumped storage, improve the cost sharing and dredging mode of pumped storage power stations, and improve the project. Promote the planning and construction of pumped storage power stations, enhance the regulation capacity of the power system, and promote the absorption of new energy and the adjustment of energy structure. 27 [Hydrogen Energy] People's governments at or above the county level and their relevant departments shall encourage the development of new energy sources for hydrogen production by electrolysis of water, promote the innovation of key core technologies for hydrogen production, and promote the large-scale development of the green hydrogen industry. Establish and improve the standard system of green hydrogen storage and transportation, scientifically plan multi-phase storage and transportation channels of hydrogen energy, and form a diversified storage and transportation pattern. Strengthen the management of the whole industry chain of hydrogen energy, promote the research and development of hydrogen energy equipment, optimize the layout of hydrogenation infrastructure, and expand the demonstration application of hydrogen energy in transportation, distributed heating, green steel, green chemical industry and other fields. 28 [Integration of New Energy Buildings] New buildings and new energy supply systems such as solar energy, geothermal energy and biomass energy are encouraged to be designed, constructed and checked synchronously, and the application of new energy supply systems in existing buildings is supported to increase the proportion of integrated application of new energy buildings. Article

29 [Green Transformation of Traditional Industries] Encourage traditional energy enterprises such as oil, gas and coal to utilize their own mining rights, land and other resources in accordance with the law and regulations, strengthen the integration of oil and gas exploration and development with the development and utilization of new energy sources such as solar energy, wind energy and geothermal energy, promote the development and utilization of new energy sources and the substitution of production energy, and promote the green low-carbon transformation of traditional industries. 30 [Industrial Cluster Development] People's governments at or above the county level shall cultivate and build new energy industrial clusters with distinctive features, complete chains, high-end brands and remarkable driving effects, promote the deep integration of industrial chains with innovation chains, capital chains and talent chains, give full play to the leading role of leading enterprises, and promote the development of new energy industries. Mobilize the enthusiasm of private enterprises to participate in the development of new energy industry, promote the development of industrial clusters, and enhance the influence and competitiveness at home and abroad. 31 Departments of science and technology, development and reform, industry and information technology of provincial and district-based municipal people's governments shall promote scientific and technological innovation in the field of new energy equipment, such as solar power generation system, fan equipment, key equipment for pumped storage power generation, new energy storage batteries and hydrogen storage equipment. Promote the development and application of new technologies and materials, promote the integration and development of new energy equipment and energy electronics industry, and promote the industrial intelligence, high-end and large-scale development of new energy. 32 [Green Transformation and Upgrading] Encourage the whole society to give priority to the use of clean low-carbon energy such as wind energy, solar energy, biomass energy and geothermal energy, reduce greenhouse gas emissions, strengthen the construction of new energy application infrastructure, stimulate the potential of green energy consumption in the whole society, and promote the green transformation and upgrading of energy consumption structure.

We will encourage the upgrading of new energy facilities. New energy power generation facilities that have reached the design service life and have been assessed for safe operation and do not meet the conditions for safe operation shall be dismantled and the ecological environment shall be restored in accordance with the relevant provisions of the state and the province. New energy enterprises, equipment manufacturing enterprises, scientific research institutions and other relevant units are encouraged to carry out research on the recycling of waste materials from new energy facilities, and to establish and improve the industrial chain system for the recycling of new energy facilities. 33 The provincial people's government and its relevant departments shall guide the distribution of incremental data centers and related industries in Beijing, Tianjin and Hebei to areas rich in wind and solar energy resources, support the construction of green big data bases mainly based on new energy supply, and promote the integration and development of big data industry and new energy industry.

Relying on new energy-consuming areas such as Xiongan New Area and Beijing Daxing International Airport, we will expand the consumption of new energy power in Zhangjiakou and Chengde, and promote the coordinated consumption of new energy power in Beijing, Tianjin and Hebei. Article

34 [Zhangjiakou Renewable Energy Demonstration Zone] The provincial people's government and its relevant departments shall support the construction of Zhangjiakou Renewable Energy Demonstration Zone, support the pilot test of new energy policies, and promote the high-quality development of the whole industrial chain of photovoltaic power generation, wind power and hydrogen energy in the demonstration zone.

Zhangjiakou Municipal People's Government should establish and improve the development policy system of renewable energy demonstration zones, explore new modes of new energy development, promote new modes of green energy conservation and green consumption, promote the high proportion and SCA le application of new energy, promote industrial transformation and upgrading, promote the integration of production and city development, and promote renewable energy. IV Service Guarantee

Article 35 [Strengthening Power Grid Construction] Power grid enterprises shall moderately advance the layout, strengthen the planning and construction of power grids, carry out research on new power systems, apply advanced power technologies and equipment, and improve the level of intelligent regulation of power grids. Enhance the guarantee ability and service level of the power grid for new energy access. Article

36 [New Energy Grid Access] Power grid enterprises shall access and absorb new energy in accordance with the relevant provisions of the State, sign grid-connected agreements with new energy power generation enterprises that have been approved or filed in accordance with the relevant planning and construction of new energy development, and provide grid-connected services. Power grid enterprises should promote the wide application of new energy cloud platform, realize the online processing of the whole process of network connection, and improve the level of network connection service facilitation.

Power grid enterprises shall implement the relevant national standards for grid-connected power generation, and shall not require repeated testing of qualified grid-related equipment tested and certified by state-recognized testing and certification institutions unless necessary.

New energy power generation enterprises shall carry out the construction and commissioning of power stations in accordance with the relevant technical standards and specifications of the state for the access of power stations to the power grid, and the equipment used in the power grid shall pass the inspection and certification, and shall not shut down or adjust the parameters without authorization. 37 [Market Trading] The province shall establish and improve a market mechanism adapted to a high proportion of new energy, support new energy power generation enterprises and power users to participate in green power trading and green certificate trading, attract social capital with market returns, promote sustainable investment in new energy and promote new energy consumption.

Promote the participation of new energy storage in power market and dispatching application. New energy storage enterprises can choose to participate in electricity market transactions independently, form prices in a market-oriented way, and promote the establishment of energy storage market. Power grid enterprises should carry out scientific dispatch and play the role of energy storage and peak shaving. Article

38 [Flexible Transformation of Thermal Power] The competent energy department of the provincial people's government shall explore and improve the compensation mechanism for deep peak shaving of coal-fired power, guide coal-fired power generation enterprises to implement flexible transformation of coal-fired power units, enhance the peak shaving capacity of units, and ensure the safe and stable supply of new energy. 39 [Demand Side Response] People's governments at or above the county level shall strengthen power demand side management, coordinate the economic benefits of enterprises and the overall interests of society, guide enterprises to participate in the interaction of power supply, power grid, load and energy storage, enhance the capacity of power demand side response to valley filling, and promote the absorption of new energy.Article

40 [Carbon Trading] People's governments at or above the county level and their departments of ecological environment, development and reform shall encourage new energy enterprises to participate in voluntary greenhouse gas emission reduction and support certified emission reduction to participate in trading. Article

41 [Pipeline Network Management] If the gas and heat produced by biomass resources meet the technical standards for gas and heat pipelines to enter the network, the enterprises operating gas and heat pipelines shall accept their access to the network.

Petroleum sales enterprises shall incorporate bio-liquid fuels that meet the national standards into their fuel sales system in accordance with the relevant provisions of the state and the province. Article

42 [Land Use Guarantee] The departments of natural resources, forestry and grassland of the people's governments at or above the county level shall establish a linkage mechanism for the examination and coordination of land use, forest use, grass use and sea use for new energy projects, and guarantee the construction needs of land use, forest use, grass use and sea use for new energy projects in accordance with the relevant provisions of the state and the province.

We will encourage the use of unused land and stock construction land to develop new energy industries. On the premise of strict ecological protection, new energy projects are encouraged to be built in deserts, deserts, grasslands outside basic grasslands, and artificial waters and beaches used for aquaculture. New energy projects shall not be constructed in permanent basic farmland, basic grassland and first-class protected forest land; the project site shall avoid cultivated land, ecological protection red line, historical and cultural protection line, special natural landscape value and cultural identification area, natural forest land, national desertification land closed protection area, etc.; if the nature reserve is involved, it shall comply with the requirements of relevant laws, regulations and policies of the nature reserve. 43 People's governments at or above the county level and their relevant departments shall explore the establishment of a green channel for the examination and approval of new energy projects, standardize the examination and approval items, streamline the examination and approval links, optimize the examination and approval process, reduce the time limit for examination and approval, and implement the whole process of online processing, one-time notification, parallel examination and approval, tolerance and acceptance, and multi-evaluation. 44 [Territorial Support] People's governments at the county level shall support the construction of new energy projects, strengthen the coordination of departments, improve the efficiency of Pre-project formalities, urge investors to strengthen the quality and safety management of projects, and complete the construction of new energy projects on schedule. 45 [Technological Innovation] The people's governments at or above the county level and their departments of science and technology, development and reform, and energy shall improve the institutional mechanisms and policy measures to support the innovative development of new energy sources, intensify the training and introduction of talents, and promote the construction of innovative platforms such as key state laboratories, technological innovation centers and industrial innovation centers. We will guide and support enterprises, scientific research institutions and institutions of higher learning to carry out industry-university-research cooperation both inside and outside the province, and carry out independent innovation and transformation of key new energy technologies. 46 [Financial Support] People's governments at or above the county level may arrange funds to support the following new energy development matters in light of the actual situation of new energy development and their own financial situation:

(1) Scientific research, technological development and standard-setting for the development and utilization of new energy;

(2) Construction of new energy science and technology innovation platform;

(3) Construction of new energy resources exploration and survey and related information system;

(4) Subsidies for the construction of new energy development and utilization demonstration projects or the purchase of facilities and equipment;

(Five) other matters concerning the development and utilization of new energy. Article

47 [Financial Support] Financial institutions are encouraged to implement financial support policies, provide financial service products and provide credit support for new energy projects in accordance with the characteristics of investment in new energy projects. Enterprises that have been included in the list of renewable energy power generation subsidy projects shall be supported by subsidized loans in accordance with the principles of marketization and legalization. the county level and their relevant departments shall play the role of government-guided funds and guide social capital to invest in new energy projects. Private equity funds such as venture capital funds are encouraged to invest in new energy projects. Supporting new energy enterprises to finance directly through public issuance of stocks, bonds and real estate trust and investment funds. Article

48 [Tax and Fee Support] Tax authorities shall implement new energy tax preferential policies such as additional deduction of R & D expenses, tax refund of value-added tax, preferential treatment of high-tech enterprise income tax, and immediate refund of wind power value-added tax according to law. Article

49 [Safety in Production and Protection of Ecological Environment] Units and individuals engaged in the investigation, development and utilization of new energy sources shall consider the carrying capacity of the environment, abide by relevant laws and regulations on safety in production, occupational health and protection of the ecological environment, strengthen the management of safety in production, fulfill the obligation of land reclamation, protect the ecological environment and prohibit destructive development and utilization. Chapter

V Legal Liability

Article 50 [Legal Liability 1] Where the competent energy departments and other relevant departments and institutions of the people's governments at or above the county level violate the provisions of these Regulations and commit one of the following acts, the people's governments at the corresponding levels or the relevant departments of the people's governments at higher levels shall order them to make corrections. The persons in charge who are held responsible and other persons directly responsible shall be given sanctions in accordance with the law; where a crime is constituted, they shall be investigated for criminal liability in accordance with the law:

(1) failing to implement the administrative license in accordance with the law;

(2) failing to investigate and punish the illegal acts in accordance with the law;

(3) Imposing administrative penalty in violation of statutory authority and procedures;

(4) Other acts of abuse of power, favoritism and dereliction of duty. Article

51 [Legal Liability 2] Where, in violation of the provisions of these Regulations, an enterprise operating a fuel gas pipeline network or a heating power pipeline network does not allow fuel gas or heating power that meets the technical standards for access to the network to enter the network, thus causing economic losses to the fuel gas or heating power production enterprise, it shall be punished in accordance with the relevant provisions of the Renewable Energy Law of the People's Republic of China. Article

52 [Legal Liability 3] Where a petroleum sales enterprise, in violation of the provisions of these Regulations, fails to incorporate bio-liquid fuels that meet the national standards into its fuel sales system in accordance with the relevant provisions, thus causing economic losses to the bio-liquid fuel production enterprise, it shall be punished in accordance with the relevant provisions of the Renewable Energy Law of the People's Republic of China. Article

53 [Legal Liability 4] Where laws and administrative regulations have stipulated legal liability for acts violating the provisions of these Regulations, such provisions shall prevail.Chapter

VI Supplementary Provisions

Article 54 [Definition of Terms] The meanings of the following terms used in these Regulations are as follows:

(1) Biomass energy refers to the energy converted from plants, feces and urban and rural organic wastes in nature.

(2) Bio-liquid fuels refer to liquid fuels such as methanol, ethanol and biodiesel produced from biomass resources. Article

55 [Date of Implementation] These Regulations shall come into force as of (date). The Regulations on the Development and Utilization of New Energy in Hebei Province adopted at the 26th Meeting of the Standing Committee of the Eighth People's Congress of Hebei Province on April 25, 1997 shall be repealed at the same time.
