2021, through a friend's introduction, Qumou met Huang Mou, who was doing illegal sand suction business in Fujian. Huang Mou has his own sand suction boat, looking for him to take sea sand at a price of about 10 yuan/ton, and then sell it back to Zhoushan at a high price, with considerable profits. As a result, Qumou turned off the AIS automatic identification system of his two inland river vessels, and then ventured into the sea to transport illegal sea sand back to Zhoushan from Fujian. After six people, such as Qu Mou and Cai Mou, resold them layer by layer, the market price of these sea sand was raised to 80 yuan/ton.
Sea transportation escaped the supervision of the marine police, and the sea sand was sold out at a high price as soon as it landed. Six people, such as Qumou and Caimou, were arrested by the public security organs three months later and transferred to the Daishan County Procuratorate for examination and prosecution.
The prosecutor learned from the Fujian Provincial Department of Natural Resources that up to the time of the incident, only one company in Fujian had the qualification to legally exploit sea sand, but the company had not exploited sea sand. Combined with the statements of Qumou and his crew, it can be determined that they purchased illegal sea sand. When calculating the amount and quantity of the suspect's sale of sea sand, the prosecutor found that Qumou sold more than 70000 tons of sea sand to Caimou, while Caimou sold more than 110000 tons of sea sand to his family. Where did the difference of more than 40000 tons come from?
By looking through a large number of transfer records, the prosecutor found that Cai frequently transferred large amounts of money to Qumou's girlfriend Zhang from May to September 2021. Originally, Qumou borrowed Zhang's account to receive part of the sea sand money. Accordingly, the prosecutor increased the amount of Qumou's sea sand money transferred by the public security organs for examination and prosecution by more than 1 million yuan. After examination, Qumou transported and traded more than 110000 tons of illegal sea sand, with a transaction value of more than 3.37 million yuan and an illegal profit of more than 800000 yuan. In April
this year, after the procuratorate filed a public prosecution, the Daishan court sentenced six people, including Qumou, to fixed-term imprisonment ranging from eight months to three years and four months, and fined them for concealing and concealing the crime. When
handling the case, the prosecutor found that millions of tons of illegal sea sand were estimated to be transported from Zhoushan every year, but they were criminally investigated and punished. In order to further dig out the hidden clues of supervision, the Daishan County Procuratorate decided to carry out the integrated supervision of criminal and administrative procuratorial work on the illegal crimes involving sea sand transportation. Prosecutors have visited public security and maritime police departments many times to collect case information, establish a large data supervision model, and accurately obtain the supervision clues of illegal and criminal activities involving sea sand transportation through collision and screening of key information such as personnel identity and amount of money involved.
With the support of Zhoushan Procuratorate, the model has been popularized and applied in the procuratorial organs of the whole city. Up to now, more than 30 clues have been found to supervise the withdrawal of criminal cases involving sea sand crimes, 4 cases and 4 persons have been supervised, and more than 10 illegal clues have been found that the relevant vessels and personnel should be punished but not punished, which have been transferred to the administrative procuratorial departments for supervision.
In addition, in view of the problem of illegal loading and unloading, the procuratorate issued procuratorial suggestions to the relevant departments to urge the rectification and clearance of illegal loading and unloading points that have not been filed by the port and shipping administration departments.
