After investigation, defendant Chen Mou-mou, Wang Mou-mou and others (another case) jointly invested RMB 3.18 million to purchase ships, and Wang Mou-mou hired Shi Mou-mou as captain to lead the crew to sea without a license to exploit sea sand. Chen Mou-mou, together with others (another case), operated the sand field for the distribution of the sea sand mined, and arranged the co-defendant Weng Mou-mou (another case) to watch the accounts in the sand field, to be responsible for docking with Wang Mou-mou, to dispatch and transport the sea sand mined by Shi Mou-mou. 2019, Shi led the crew to drive the ship five times, using the sand pumping pipe on the ship to illegally extract sea sand on the sea surface, and then unloaded the sand five times at the wharf, with a total weight of 10200 tons. Wang Mou-mou received the sea sand at the wharf and handed it over to Weng Mou-mou, who arranged forklifts and transport vehicles to transport the sea sand to the sand field, and then Chen Mou-mou and others processed the sea sand for sale. After appraisal, the total value of the above sea sand is 549780 yuan, and the total value of the damage to mineral resources caused by mining the above sea sand is 549780 yuan. On October 22 of the same year, Shi Mou again led the crew to drive the ship and illegally extracted 1870.72 tons of sea sand by using the sand pumping pipe on board, which was later seized by the relevant departments. After appraisal, the value of this batch of sea sand is 101954 yuan, and the value of mineral resources damage caused by mining the above sea sand is 101954 yuan. After trial,
the court held that the defendant Chen Mou-mou, Shi Mou-mou and Wang Mou-mou, together with their co-defendants, violated the provisions of the Mineral Resources Law and mined without obtaining a mining license, the circumstances were particularly serious, and the acts of the three defendant constituted the crime of illegal mining. Defendant Chen Mou-mou, Shi Mou-mou and Wang Mou-mou were sentenced to fixed-term imprisonment ranging from one year, four months to three years and six months, with fines and confiscation of illegal income.
The judge reminded that sea sand is an extremely important marine resource. Illegal sand mining will not only discharge a large amount of sewage, but also change the topography of the coast and related areas, break the balance of sediment erosion and siltation, seriously threaten the marine ecological environment, and cause different depths of the waterway, destroy the waterway and affect navigation safety.
Sea sand contains a large amount of chloride ions, which is highly corrosive. If it is used directly without treatment in the construction market, it will cause steel corrosion and reduce the durability of the structure due to excessive chloride ion content. The illegal exploitation of sea sand into the construction market will bring hidden dangers to the quality and safety of the project.
