The establishment of mining right is the prerequisite for the transfer of mining right. All parts of the province attach great importance to the establishment of mining rights and have achieved remarkable results, and the overall situation is good. However, there are still some problems, such as unreasonable setting, inadequate and imprecise demonstration of scope, and non-standard preparation for transfer. The following suggestions are put forward to further strengthen the work related to the setting of mining rights, which should be implemented. Under the unified leadership of the local government, the departments in charge of natural resources
at the county level shall strictly implement the system of joint reconnaissance and joint demonstration by the departments, and do a good job in the preliminary basic work such as the demonstration of the scope of mining rights in their respective jurisdictions in accordance with the mineral resources planning. Relevant experts shall be organized to conduct comprehensive demonstration on the scope of exploration blocks for the proposed exploration right. The proposed mining right shall be verified and approved by relevant departments such as ecological environmental protection, emergency management, forestry, public security, water conservancy and local township (town, street) to determine the scope of the mining area and carry out geological exploration.
2. To promote the application
of digital platform for the proposed transfer of mining rights, the competent departments of natural resources at the county level shall use the digital platform of provincial spatial governance to carry out spatial adaptability matching and inquiry, and if the requirements are met, the digital platform shall be used to accurately fill in and upload relevant information and data on the establishment of mining rights, and the relevant information and data on the establishment of mining rights shall be collected. Paper materials will no longer be submitted to mining rights trading institutions. The transferor may directly entrust the municipal trading business to the provincial trading institutions.
3. Strengthen the technical support
for setting up demonstration. The Provincial Geological Institute is entrusted by the Provincial Department to undertake the technical support for setting up mining rights. The Provincial Geological Institute shall provide technical support for the maintenance of the transfer project database, the demonstration of the scope of the mining area and the on-the-spot verification, and review and issue opinions on the relevant information and data materials of the mining rights set up by the districts and municipalities through the examination and transfer of the digital platform.
4. Further improve the management
of the transfer transaction. After receiving the materials entrusted by the transaction and pushed by the digital platform, the mining rights trading institutions shall carefully examine the transaction materials and implement the transfer according to the implementation plan. Relevant information on the proposed mining rights, land use and other related safeguards issued by the people's government at the county level, the contents and costs of the completion of the net mining policy, special clauses, and the contact information for supervision and reporting shall be included in the transfer announcement and issued in a timely manner. The mining right trading institution shall be responsible for the fairness of the transaction, and shall do a good job in the filing management of the transaction archives in a timely manner.
5. To improve the procedures
for issuing the transfer announcement, the transferor of mining rights and the mining rights trading institution shall do a good job in issuing the announcement of mining rights trading information in accordance with the regulations, so as to ensure that the content of the announcement issued on each platform is consistent and the time is synchronized. At the same time, paper announcements should be posted in the information bulletin boards of towns (streets) and villages (communities) where mining rights are located. The photocopied materials published in the public announcement shall be stored in the transaction files together.
6. To strengthen the supervision
of trading activities, the competent departments of natural resources of districts, cities and counties (cities and districts) should further strengthen the supervision and management of transfer trading activities. All trading institutions shall improve the internal supervision mechanism, further implement one post and two responsibilities, supervise the entry of base price and the implementation of the scheme; improve the transaction complaint reporting mechanism, publish the supervision and reporting methods, and strengthen social supervision; explore the introduction of notarization mechanism, and notarize the entry of base price and the whole process of transaction by notaries of notary organs. The provincial mining rights transaction supervision group will no longer supervise the entry of the base price on the spot, and will no longer put on record the implementation plan of the transfer.
