In order to protect the river sand and gravel resources in Fogang County, the law enforcement of river sand in Fogang County can be based on evidence, and the loss of state-owned assets caused by illegal sand mining can be prevented. According to the Water Law of the People's Republic of China, the Flood Control Law of the People's Republic of China, the Regulations on Sand Mining Management of Rivers in Guangdong Province, the Opinions of the Water Resources Department of Guangdong Province on Several Issues Concerning the Implementation of the Regulations on Sand Mining Management of Rivers in Guangdong Province, the Regulations on River Management of Guangdong Province, and the Demonstration of River Sand Mining Areas and Prohibited Areas in Fogang County in 2023. The scope of river sand mineable areas and prohibited mining areas in Fogang County in 2023 is hereby announced as follows:
I. River Overview
The river section originates from Shangtan Cave in Shuitou Town and ends at Daluokeng, Liangtang Village, Longshan Town, with a total length of 281.132 kilometers. Yanling River originates from Lixi Village, Gaogang Town, and ends at Chejiao, Yanling, with a total length of 115.19 kilometers.
2. Mineable area of river sand
(I) Mineable area of the town The mineable area of Jiangzhen
is located 1 km downstream of Zhanguo Lanhepi in Fogang County. The mining area is about 1.42 km long, more than 50 m from the left bank and more than 70 m from the right bank. The mining area is about 123,100 m2. Mining area range coordinates (2000 National Geodetic Coordinate System):
(II) Gaoshan Village Minable
Area Yanling River Gaoshan Village Minable Area is located 0.5km upstream of Yanling Bridge in Fogang County, with a mining area length of about 2.86km, more than 15m from the left bank embankment toe and more than 15m from the right bank embankment toe. The mining area is about 254,300 m2. Mining area range coordinates (2000 national geodetic coordinate system):
(III) Minable area of Qiansuo
Village Yanling River The minable area of Qiansuo Village is located 2km downstream of Yanling Bridge in Fogang County, and the mining area is about 1.62 km long. It is more than 15 m away from the left bank embankment toe and more than 15 m away from the right bank embankment toe, and the mining area is about 103,800 m2. Coordinates of the mining area (2000 National Geodetic Coordinate System):
within the river sand mineable area, all sand mining activities are prohibited, except for the river sand mining right holder determined by bidding and the river sand mining by rural villagers for self-built houses.
3. River sand prohibited mining
area (I) Ershui (Qingyuan Section) prohibited mining area Ershui
(Qingyuan Section) prohibited mining area, the prohibited mining area is the whole river section of Ershui (Qingyuan Section), and the river length of the prohibited mining area is 3.4km.
(II) Prohibited mining
area of Longnan water The prohibited mining area of Longnan water covers the whole reach of Longnan water, and the river length of the prohibited mining area is 25 km.
(III) Forbidden mining
area of Sijiu River Forbidden mining area of Sijiu River. The forbidden mining area covers the whole reach of Sijiu River. The river length of the forbidden mining area is 25 km.
(IV) Dapi Water Prohibited Mining
Area Dapi Water Prohibited Mining Area. The prohibited mining area covers the whole reach of Dapi Water. The river length of the prohibited mining area is 25 km.
(V) Min'an water prohibited mining
area Min'an water prohibited mining area. The prohibited mining area covers the whole reach of Min'an water. The river length of the prohibited mining area is 23 km.
(VI) Chengjing water prohibited mining
area Chengjing water prohibited mining area covers the whole reach of Chengjing water, and the river length of the prohibited mining area is 15 km.
(VII) Longxi Water Mining
Prohibition Area Longxi Water Mining Prohibition Area covers the whole reach of Longxi Water, and the river length of the mining prohibition area is 17 km.
(VIII) Gaozhen Water Mining
Prohibition Area Gaozhen Water Mining Prohibition Area covers the whole river section of Gaozhen Water, and the river length of the mining prohibition area is 14km.
(IX) From the river source to the town and village prohibited mining area, from the river
source to the town and village prohibited mining area, from the river source to the Xiadaopai section of Tangtang Town, the corresponding river stake number is about PK 0 + 000 to PK 61 + 998, and the river length of the prohibited mining area is 62 km.
(X) Fengzhou Prohibited Mining
Area Fengzhou Prohibited Mining Area covers the section from Zhencun, Longshan Town to Daqingliao, with the corresponding river stake number of about PK63 + 422 ~ PK70 + 125, and the river length of the prohibited mining area is 6.7 km.
(XI) Liangtang Prohibited Mining
Area Gehai Prohibited Mining Area. The prohibited mining area is the section from Daqingliao of Longshan Town to the junction of Qingcheng District. The corresponding river stake number is about PK 70 + 125 ~ PK77 + 578. The river length of the prohibited mining area is 7.45 km.
(XII) Source of Yanling River ~ Dapi Water Mining
Prohibition Area Source of Yanling River ~ Dapi Water Mining Prohibition Area, the mining prohibition area is from the source of Yanling River to Sanjiangkou, the corresponding river stake number is about YK0 + 000 ~ YK22 + 717, and the river length of the mining prohibition area is 22.7 km.
(XIII) Yanling Prohibited Mining
Area Yanling Prohibited Mining Area covers the section from Yanling Community to Qiansuo Village. The corresponding river stake number is about YK25 + 574 ~ YK28 + 074. The river length of the prohibited mining area is 2.5km.
(XIV) Hemugang Prohibited Mining
Area Hemugang Prohibited Mining Area covers the river section from Hemugang to Yingde, with the corresponding river stake number of about YK29 + 665 ~ YK32 + 085, and the river length of the prohibited mining area is 2.42 km. Within the scope of the prohibited areas for
river sand mining, the application for river sand mining and the issuance of the River Sand Mining License shall be stopped, and all river sand mining activities shall be prohibited (except for river regulation and dredging projects approved by the water administration department and other relevant departments).
4. Explanation
of relevant matters (1) Any unit or individual who violates the provisions of this announcement and carries out illegal sand mining in the designated prohibited mining areas shall be investigated and punished according to law.
(2) The Water Conservancy Bureau of Fogang County shall be responsible for the interpretation of this announcement, and matters not covered herein shall be implemented in accordance with relevant laws and policies.
(3) The validity period of the announcement is from now on to December 31, 2023.
