On July 24, the Emergency Management Bureau of Gaoyao District, Zhaoqing City, Guangdong Province, issued the Investigation Report on the "4.3" General Asphyxiation Accident of Zhaoqing Gaoyao Jingang Cement Co., Ltd.
The report shows that at 23:50 on April 3, 2023, a general asphyxiation accident caused by gravel burial occurred in the factory area of Zhaoqing Jingang Cement Co., Ltd., resulting in one death and a direct economic loss of 2.008697 million yuan. After investigation, it was found that the "4.3" general suffocation accident in Gaoyao District of Zhaoqing City was a general production safety responsibility accident in which the operator climbed up the top of the gravel pile to inspect the discharge port, accidentally slipped into the feed hopper and could not climb up by himself for a long time without being found by others, and was buried by the gravel when the forklift pushed the feed hopper. In the
report, the person and unit responsible for the accident were confirmed and the handling suggestions were listed:
(I) The person responsible for the death in the accident was exempted or not investigated (1 person in total)
Li * *, male, mass, worker of Zhaoqing Jingang Cement Co., Ltd. The safety awareness was weak, and he did not realize that there was a risk factor of sliding in the loose gravel pile around the discharge port. Without taking safety precautions, he climbed up to the top of the loose gravel pile to check the discharge of the hopper, resulting in the death of the sliding hopper being buried by the gravel and suffocated. He was responsible for the accident. In view of his death in the accident, it is suggested that he should be exempted from accountability.
(2) Suggestions on administrative penalties for units responsible for accidents (1 in total)
Zhaoqing Jingang Cement Co., Ltd. Failure to implement the main responsibility of the production and business operation unit violates the provisions of Article 28, Article 35, Article 41, paragraph 2, and Article 44, paragraph 1, of the Safety Production Law of the People's Republic of China, and is responsible for the accident. It is suggested that the Emergency Management Bureau of Gaoyao District of Zhaoqing City should impose administrative penalties in accordance with the provisions of Article 114, paragraph 1 (1), of the Safety Production Law of the People's Republic of China.
(3) Suggestions on administrative penalties for those responsible for the accident (2 persons in total)
Qu * *, male, member of the Communist Party of China, principal person in charge of Zhaoqing Jingang Cement Co., Ltd. Failure to fulfill the responsibility of safety production management, failure to organize and implement the safety management regulations for night operation of the unit and the safety production operation rules for forklift loading or hopper feeding, failure to set up safety protection measures such as guardrails around the pit at the discharge port, failure to eliminate the impact of forklift operation on patrol operation, and implementation of safety risk grading management and control. Supervise and inspect the safety production work of the unit, fail to supervise and implement the safety management responsibilities of various departments, fail to timely discover and deal with the problems of safety management, safety warning signs, lack of safety protection measures at the operation site of the discharge port, and the risk of sliding down the hopper pit at the operation site, and fail to eliminate the hidden dangers of production safety accidents in time; In violation of the provisions of Article 21 (2) and (5) of the Safety Production Law of the People's Republic of China, it is suggested that the Emergency Management Bureau of Gaoyao District of Zhaoqing City should impose administrative penalties in accordance with the provisions of Article 95 (1) [14] of the Safety Production Law of the People's Republic of China.
Lin *, male, mass, person in charge of Safety and Environmental Protection Department of Zhaoqing Jingang Cement Co., Ltd. Failure to perform safety production management duties, failure to timely investigate and identify the danger of working environment in the way that the reinforcement fence in the hopper is about 1.3 meters deep underground and the loose gravel pile around the hopper is about 2 meters high; Failure to timely discover and stop the unsafe behavior of patrol operators climbing up the gravel pile to patrol the discharge port in the gravel distribution process and the behavior of forklift drivers not strictly abiding by the safety operation rules, inadequate inspection of the safety production situation of the unit, and inadequate investigation and management of hidden dangers; In violation of the provisions of Article 25 (3), (5) and (6) of the Safety Production Law of the People's Republic of China, it is suggested that the Emergency Management Bureau of Gaoyao District of Zhaoqing City should impose administrative penalties in accordance with the provisions of Article 96 of the Safety Production Law of the People's Republic of China.
(IV) Suggestions on handling other persons responsible for the accident (2 persons in total)
Zhu * *, male, mass, team leader of Storage and Transportation Department of Zhaoqing Jingang Cement Co., Ltd. Lack of unified coordination and management of the operation situation of the team workers, inadequate safety inspection, failure to organize the safety management of the operation site, failure to stop and correct the unsafe behavior of the patrol workers climbing on the top of the material pile in time, failure to urge the forklift drivers to strictly abide by the safety operation rules to confirm the safety of the operation environment, and failure to ensure the safety of the operation environment. It is suggested that Zhaoqing Jingang Cement Co., Ltd. should deal with it according to the company's relevant regulations.
Tang * *, male, mass, forklift driver of Zhaoqing Jingang Cement Co., Ltd. Driving a forklift without a motor vehicle driver's license within the permitted driving range, driving the forklift to the discharge port to push materials, failing to confirm the factors that are not conducive to safe operation in the workplace, failing to stop and observe whether someone starts to push the gravel discharge in the workplace, failing to find the potential safety hazards in the gravel discharge port, it is suggested that Zhaoqing Jingang Cement Co., Ltd. should be dismissed.
