Recently, Lincang Municipal Bureau of Ecology and Environment issued the Decision on Administrative Penalty (Linhuan Penalty [2026] No.3), Yunnan Jinjiang Cangyuan Cement Industry Co., Ltd. Address: Baita Mountain, Mengsheng Village, Mengsheng Town, Cangyuan County, Yunnan Province) was fined 22,000 yuan for failing to ensure the normal operation of automatic monitoring equipment for pollutant discharge. The company had submitted a statement to defend the request for exemption from punishment, which was not adopted after the review by the ecological environment department, and the relevant penalty decision was formally made and came into effect on January 28, 2026.

It is reported that the investigation originated from the first round of air quality clue verification by the Ministry of Ecology and Environment in October 2025. On October 21, 2025, the law enforcement officers of Lincang Ecological Environment Bureau conducted an on-site inspection of the company and found that it was suspected of having environmental violations. On October 31 of the same year, the Bureau formally filed a case for investigation (filing number: LC-530900 -2025-16).

After investigation, it was confirmed that the company had two core illegal facts: one was that the temperature of the tracing tube of the flue gas analyzer at the kiln tail was only 30 ℃, which did not meet the clear requirement of "heating temperature ≥ 120 ℃" in the Technical Specification for Continuous Monitoring of Flue Gas (SO2, NOX, Particulate Matter) Emissions from Stationary Pollution Sources (HJ 75-2017); Secondly, in the two on-site tests on October 21 and November 27, 2025, the indication errors of the six sulfur dioxide full-process standard tests exceeded ± 5%, which did not meet the relevant provisions of the Technical Requirements and Detection Methods for Continuous Emission Monitoring System of Flue Gas (SO2, NOX, Particulate Matter) from Stationary Pollution Sources (HJ 76-2017). The above actions have constituted an environmental violation of "not guaranteeing the normal operation of automatic monitoring equipment". On January 5

, 2026, Lincang Municipal Bureau of Ecology and Environment served a prior (hearing) notice of administrative penalty to the company, clearly informing it of the illegal facts, the basis of the penalty and the decision of the proposed penalty, and guaranteeing its right to state and defend. On January 6, the company submitted a statement and defense, requesting exemption from punishment on the grounds of "no subjective intent, timely completion of rectification, and courage to assume social responsibility".

On January 23, the Bureau of Ecology and Environment of Lincang City reviewed the company's statement and defense opinions in accordance with the law, and formed a clear review opinion: some of them adopted the objective circumstances of "no subjective intent" and the behavior of "timely rectification", and in the discretion, the factors of correcting attitude, cooperating with investigation and remedial measures were considered at the lowest limit. However, because environmental protection is a statutory mandatory obligation of enterprises, "timely rectification" and "assuming social responsibility" do not constitute exemptions, so the request for "exemption from punishment" is not accepted. In accordance with Article 36, paragraph 4, of the Regulations on the Administration of Pollutant Discharge Permits and the relevant provisions of the Rules and Benchmark Provisions on the Discretionary Power of Administrative Penalties for Ecological Environment in Yunnan Province (2023 Edition), the

Bureau made a fine of 22000 yuan in accordance with the law, taking into account the circumstances of the company's illegal acts, the rectification situation and the attributes of the ecological environment control unit. The

penalty decision clearly States that the company shall pay the fine to the State Treasury of Lincang City within 15 days from the date of receipt of the decision, and that the overdue fine shall be increased by 3% per day, and the amount of the fine shall not exceed the fine itself. If they refuse to accept the punishment decision, they may apply to the Lincang Municipal People's Government for administrative reconsideration within 60 days, or bring an administrative lawsuit to the People's Court of Gengma Dai and Wa Autonomous County within 6 months, and the execution of the punishment decision shall not be suspended during the period of reconsideration and litigation.
