I General Provisions
Article 1 In order to protect and improve the environment of Chaohu Lake Basin, prevent and control water pollution, protect water ecology and build a beautiful Chaohu Lake with green development, these Regulations are formulated in accordance with the Code of the People's Republic of China on Ecological Environment and relevant laws and administrative regulations, and in light of actual conditions. Article
2 These Regulations shall apply to the prevention and control of water pollution in the Chaohu Lake Basin. The Chaohu Lake Basin referred to in
these Regulations includes the whole administrative areas of Chaohu Lake, Chaohu City, Feixi County, Feidong County, Shucheng County, Luyang District, Yaohai District, Shushan District and Baohe District of Hefei City. As well as the catchment areas of rivers, lakes, reservoirs and channels that affect the water body of Chaohu Lake in the administrative areas of Changfeng County, Lujiang County, Hanshan County, Hexian County, Wuwei City, Yuexi County, Jiujiang District of Wuhu City and Jin'an District of Lu'an City. Where
relevant laws and regulations provide otherwise for the protection of drinking water sources and scenic spots, such provisions shall prevail. Article
3 The water environment of the Chaohu Lake Basin shall be protected at three levels. For the body of Chaohu Lake, the land area within 1,000 meters of the extension of the shoreline of Chaohu Lake, the land area within 10,000 meters of the upstream of the river course into the lake and the land area within 200 meters on both sides of the shoreline are the first-level protection areas; the land area within 1,000 to 3,000 meters of the extension of the shoreline of Chaohu Lake, the land area within 10,000 meters of the upstream of the river course into the lake and the land area within 200 to 1,000 meters on both sides of the shoreline are the second-level protection areas; other areas are. The specific scope of the first, second and third-level water environment protection zones in
the Chaohu Lake Basin shall be determined and announced by the provincial people's government. Article
4 In order to prevent and control water pollution in the Chaohu Lake Basin, we must practice the concept that green water and green hills are Jinshan and Yinshan, implement the relevant decision-making and deployment of the state, and adhere to the principles of giving priority to protection, giving priority to prevention, unified planning, comprehensive management, public participation and responsibility for damage; Implement the management system of combining river basin management with administrative region management, coordinate the systematic management of mountains, rivers, forests, fields, lakes, grass and sand; implement strict environmental protection standards, take strict control measures, establish a strict monitoring system, effectively prevent and control industrial pollution, domestic pollution and agricultural non-point source pollution, strengthen ecological management, reduce the eutrophication of Chaohu Lake, and promote the fundamental improvement of Chaohu Lake water quality. Article
5 People's governments at or above the county level shall incorporate the prevention and control of water pollution in the Chaohu Lake Basin into their national economic and social development plans and set up special funds for the prevention and control of water pollution. People's governments at or above
the county level shall take economic and technological measures conducive to the prevention and control of water pollution, encourage and support scientific and technological research, application of achievements and industrial development in the prevention and control of water pollution, and encourage and guide social forces to participate in the prevention and control of water pollution in the Chaohu Lake Basin. People's governments at or above
the county level shall publicize public information on water pollution prevention and control in the Chaohu Lake Basin, such as water environment quality, water pollutant discharge, water pollution emergencies, target responsibility, assessment and evaluation, according to law on public service platforms. People's governments
at all levels and relevant departments of people's governments at or above the county level should strengthen the publicity and popularization of green development mode and lifestyle, and enhance the awareness of the whole society to consciously protect the water environment of Chaohu Lake Basin. Article
6 The people's governments at all levels in the Chaohu Lake Basin shall be responsible for the water environment quality in their respective administrative areas.
The provincial people's government has established a deliberation and coordination mechanism for the prevention and control of water pollution in the Chaohu Lake Basin to coordinate and solve major problems in the prevention and control of water pollution in the Chaohu Lake Basin.
Hefei Municipal People's Government takes overall responsibility for the water environment quality of Chaohu Lake; according to the water pollution prevention and control plan of Chaohu Lake Basin formulated by the state, it formulates and organizes the implementation of the water pollution prevention and control action plan of Chaohu Lake Basin, and guides, coordinates and supervises the people's governments at the county level within its jurisdiction to perform their duties of water pollution prevention and control. The people's governments of
Lu'an, Anqing, Wuhu, Ma'anshan and the relevant county-level people's governments shall strengthen the prevention and control of water pollution in the Chaohu Lake Basin within their respective administrative areas, ensure that the water quality of the river sections out of the Chaohu Lake Basin meets the requirements of water environment quality, and implement the responsibility system for the transfer of water quality across the upstream and downstream sections of the administrative boundaries of cities and counties.
Township people's governments shall assist the people's governments at higher levels and relevant departments in strengthening the comprehensive improvement of sewage interception, silt removal, cleaning and ecological restoration of rivers entering lakes, and implementing agricultural and rural pollution control measures such as the establishment of garbage and sewage collection and disposal systems. Article
7 The competent department of ecological environment of the provincial people's government shall exercise unified supervision and management over the prevention and control of water pollution in the Chaohu Lake Basin. The competent department of ecological environment of the municipal people's government with districts shall exercise unified supervision and management over the prevention and control of water pollution within its administrative region.
The Provincial Chaohu Administration shall supervise and administer the prevention and control of water pollution in the first-level water environment protection zones, and perform other duties determined by the Provincial People's Government and entrusted by the Hefei Municipal People's Government.
Transportation departments shall supervise and administer the prevention and control of water pollution by ships. The relevant departments of the people's governments at or above
the county level, such as development and reform, industry and information technology, water administration, finance, natural resources, housing, urban and rural construction, agriculture and rural areas, forestry, health, market supervision, culture and tourism, and urban management, shall supervise and administer the prevention and control of water pollution in the Chaohu Lake Basin within their respective responsibilities. Article
8 Any unit or individual shall have the obligation to protect the water environment of the Chaohu Lake Basin and shall have the right to report acts of pollution and damage to the water environment. The people's governments at or above the county level in
the Chaohu Lake Basin and their relevant departments shall commend and reward the units and individuals who have made remarkable achievements in the prevention and control of water pollution. Chapter
II Supervision and Management
Article 9 People's governments at or above the county level shall organize the implementation of the water pollution prevention and control plan for the Chaohu Lake Basin formulated by the State. The Provincial Chaohu Administration shall organize and implement water pollution prevention and control measures in the first-level water environment protection zones in accordance with the water pollution prevention and control plan and action plan of the Chaohu Lake Basin.
The formulation of economic and social development plans and various development and construction activities shall conform to the Chaohu Lake Basin Water Pollution Prevention and Control Plan formulated by the State. Article
10 The provincial people's government shall, in accordance with the needs of water pollution prevention and control in the Chaohu Lake Basin and in combination with the carrying capacity of the water environment in the Chaohu Lake Basin, formulate local standards for the discharge of water pollutants that are stricter than national standards.Article
11 The provincial people's government shall, in accordance with the provisions of the State Council, reduce and control the total discharge of key water pollutants in the Chaohu Lake Basin. The competent department of ecological environment of
the provincial people's government shall, in accordance with the regulations, regularly announce the completion of the total discharge control targets of key water pollutants in cities and counties of the Chaohu Lake Basin.
In areas where the total discharge control targets of key water pollutants are exceeded or the water environment quality improvement targets are not fulfilled, the competent department of ecological environment of the provincial people's government shall, in conjunction with the relevant departments, interview the principal responsible persons of the local people's government and its relevant departments. Suspend the examination and approval of the ecological environmental impact report and the ecological environmental impact report form of the newly added construction projects with the total discharge of key water pollutants. The interview and rectification should be made public to the public. Article
12 In the formulation of territorial spatial planning, river basin construction, development and utilization planning and relevant special plans for industry, agriculture, fisheries, animal husbandry, forestry, energy, water conservancy, transportation, urban construction, tourism and natural resources development, ecological environmental impact assessment shall be carried out, and chapters or explanations on ecological environmental impact shall be compiled. The examination and approval organ shall not examine and approve the draft plan without writing a chapter or explanation on the impact on the ecological environment. The ecological environmental impact assessment shall be carried out in accordance with the law for the construction, reconstruction and expansion of construction projects and other water facilities that directly or indirectly discharge pollutants into water bodies in
the Chaohu Lake Basin. If the ecological environment impact report or the ecological environment impact report form of a construction project has not been examined or approved by the competent department of ecological environment with the power of examination and approval according to law, or has not been re-examined and approved by the original examination and approval department, the construction unit shall not start construction. The registration form of
ecological environmental impact shall be put on record. Article
13 The facilities for prevention and control of water pollution of a construction project shall be designed, constructed and put into use simultaneously with the principal part of the project. For a construction project for which an ecological environment impact report or an ecological environment impact report form has been
prepared, its water pollution prevention and control facilities shall not be put into production or use until they have been checked and accepted by the construction unit in accordance with the provisions of the State; those that have not been checked and accepted or have failed to pass the check and acceptance shall not be put into production or use. Water pollution prevention and control facilities shall not be dismantled or left idle without authorization. After the construction projects specified in the
preceding paragraph are put into production or use, the post-assessment of ecological environment impact shall be carried out in accordance with the provisions of the competent department of ecological environment under the State Council. Article
14 The competent department of ecological environment shall supervise and inspect the design, construction, acceptance, production or use of water pollution prevention and control facilities for construction projects, as well as the implementation of other measures for ecological envi ronment protection determined in the report on the impact of ecological environment and the report form on the impact of ecological environment. Article
15 The Hefei Municipal People's Government shall improve the water environment monitoring system, establish an information sharing database, build a comprehensive information platform for the water environment of the Chaohu Lake Basin, and promote the informationization, precision and grid of water environment supervision on the basis of geospatial information, water and rain conditions in the basin, and the monitoring system for point and non-point source pollution. Promote the construction of digital Chaohu Lake. Article
16 The competent department of ecological environment shall be responsible for monitoring the quality of water environment and the quality of water resources in water functional areas. The competent department of ecological environment of
the provincial people's government shall plan and set up monitoring points for water environment quality, and set up an automatic water quality monitoring system at the junction of Chaohu Lake body, rivers entering and leaving Chaohu Lake and municipal administrative areas across districts.
Provincial Chaohu Administration shall monitor the water environment quality of Chaohu Lake and the entrance and exit sections of the main rivers entering and exiting Chaohu Lake, and report the monitoring results to the competent department of ecological environment of the provincial people's government; the competent department of ecological environment of the provincial people's government shall report the monitoring results to the competent department of ecological environment of the relevant municipal people's government with districts and the people's government at the county level, and issue them uniformly. Article
17 The people's governments of relevant cities and counties shall establish a joint prevention and control mechanism to coordinate the prevention and control of cross-border water pollution, joint monitoring of water quality, information sharing, joint law enforcement and emergency disposal of sudden water environmental incidents, so as to improve the quality of water environment and ensure the safety of water environment. Article
18 The Chaohu Lake Basin shall implement the river length system and the lake length system, establish the river length system and the lake length system at the provincial, municipal, county and township levels, and organize and lead the water resources protection, water shoreline management, water pollution prevention and control, and water environment management of rivers and lakes within its administrative region at different levels and sections. The superior river and lake chiefs are responsible for organizing the assessment of the corresponding river and lake chiefs at the next level. Article
19 The people's governments at or above the county level in the provinces and Chaohu Lake Basin shall establish and improve the ecological compensation mechanism for surface water sections and implement the responsibility for water environment quality management in their respective administrative regions. Article
20 The target responsibility system and assessment system shall be implemented for the protection of the water environment in the Chaohu Lake Basin, and the law enforcement of the protection of the water ecological environment in the Chaohu Lake Basin, the completion of the annual work objectives, the quality of the ecological environment, the use of funds and the satisfaction of the public shall be taken as the contents of the assessment and evaluation of the people's governments at all levels and their responsible persons. The results of assessment and evaluation serve as an important basis for the comprehensive assessment, rewards, punishments, appointment and removal of leading groups and cadres. The results of assessment and evaluation shall be made public to the public. People's governments at or above
the county level shall regularly report to the people's governments at the next higher level and the standing committees of the people's congresses at the same level on the prevention and control of water pollution in the Chaohu Lake Basin. Chapter
III Prevention and Control
of Pollution Article 21 The Environmental Quality Standards for Surface Water shall apply to the water quality of the Chaohu Lake Basin. The water quality of Chaohu Lake, Fengle River, Hangbu River, Baishitian River, Zhaohe River, Zhegao River, Yuxi River and Paihe River is protected according to Class III water standard, and the water quality of Nanfei River and Shiwuli River is protected according to Class IV water standard. The people's governments at the municipal and county levels
with districts shall take comprehensive measures such as pollution control, pollution interception and pollution control to strengthen the comprehensive management of the whole river basin, including the Nanfei River, the Shiwuli River, the Paihe River and the Shuangqiao River; Strengthen the water quality protection of the clear water source rivers of Chaohu Lake, such as Hangbu River and Fengle River, and the water diversion channels from the Yangtze River to the Huaihe River, such as Zhaohe River and Baishi Tianhe River, to control and reduce the pollution load into the river and ensure that the water quality requirements are met. Article
22 The relevant departments of the provincial people's government, such as development and reform, industry and information technology, shall, in conjunction with the competent departments of ecological environment, draw up catalogues of industries and products prohibited and restricted in the Chaohu Lake Basin in accordance with the provisions of the State and submit them to the provincial people's government for approval for implementation. People's governments at or above the
county level shall supervise the implementation of mandatory cleaner production audits by enterprises, and shall set a time limit for eliminating backward technologies and equipment that pollute the water environment of the Chaohu Lake Basin. Article
23 The following acts are prohibited in Class I, II and III water environment protection zones:
(1) Newly-established chemical pulp and paper enterprises;
(2) Newly-established small projects with serious water pollution, such as tanning, chemical industry, printing and dyeing, electroplating, brewing, cement, asbestos and glass;
(3) Sale and use of phosphorus-containing detergents;
(4) Reclaiming land from lakes;
(5) Other acts prohibited by laws and regulations.
It is strictly restricted to build large and medium-sized projects with serious water pollution such as tanning, chemical industry, printing and dyeing, electroplating, brewing, cement, asbestos and glass in the three-level water environment protection zones; if it is really necessary to build new projects, it shall be reported to the competent department of ecological environment of the provincial people's government for approval in advance. Among them, projects discharging pollutants containing nitrogen and phosphorus shall be replaced by reduction according to the total annual discharge targets of key water pollutants such as nitrogen and phosphorus.In addition to the implementation of the provisions of the first paragraph of Article 23 of these Regulations, the following acts are also prohibited in the first-level and second-level
water environment protection zones:
(1) Building and expanding projects with serious water pollution, such as tanning, chemical industry, printing and dyeing, electroplating, brewing, cement, asbestos and glass;
(Two) build and expand sewage outlets other than sewage outlets for centralized sewage treatment facilities. Article
25 In addition to implementing the provisions of Paragraph 1 of Article 23 and Article 24 of these Regulations, the following acts are also prohibited in the first-level water environment protection zones:
(1) Building or expanding construction projects that discharge water pollutants;
(2) Transportation of highly toxic chemicals and other dangerous chemicals that are prohibited by the State from being transported by inland rivers;
(3) Establishment of facilities for storage and transportation of highly toxic substances and dangerous chemicals;
(4) Engaging in enclosure and cage culture;
(5) Establishing livestock and poultry farms;
(6) Engaging in aquatic catering operations;
(7) Changing the use of wetlands or occupying wetlands such as reclamation, reclamation and landfill;
(8) Other activities prohibited by laws and regulations that may pollute water quality. Water ecological environment control and protection, flood control, drought relief, water supply, roads, waterway regulation projects and projects that
must be constructed, as well as major projects and projects submitted by the provincial people's government to the state for approval, shall go through relevant formalities in accordance with relevant laws and administrative regulations. In the process of handling the relevant formalities, the relevant departments shall seek the opinions of the Chaohu Administration.
The Hefei Municipal People's Government shall take measures to specify the time limit for dismantling the existing production projects discharging water pollutants in the first-level water environment protection zones. Article
26 Construction projects in the first-level water environment protection zones shall not reduce the area of water areas or beaches. For the construction of water ecological environment control and protection, flood control, drought relief, water supply, roads, waterway regulation projects and projects, as well as major projects and projects submitted by the provincial people's government to the state for approval, they shall be scientifically demonstrated and submitted to the provincial people's government for approval with the consent of the water administration department of the provincial people's government, and at the same time, equivalent alternative projects shall be built or other functional remedial measures shall be taken. The construction of wetlands around the lake, landscape forest belts around the lake and pollution control projects in the first-level
water environment protection zones shall be examined by the Chaohu Lake Administration and go through relevant formalities according to law. Article
27 Where pollutants are discharged directly or indirectly into a water body, a pollutant discharge permit shall be obtained in accordance with the relevant provisions; the operating unit of a centralized urban sewage treatment facility shall also obtain a pollutant discharge permit.
Pollutant discharge units shall construct standardized sewage outlets in accordance with the relevant provisions of the state and provinces, set up signs marking the names of the units and the types, concentrations and quantities of pollutants discharged, and set up sewage sampling outlets inside and outside the factory boundary respectively. If a
pollutant discharging unit intermittently discharges water pollutants, it shall discharge them in accordance with the time approved by the competent department of ecological environment. The time for discharging water pollutants shall be announced to the public. The
construction unit shall obtain the consent of the competent department of ecological environment for the construction, reconstruction and expansion of sewage outlets in rivers and lakes; the competent department of ecological environment shall solicit the opinions of the departments of transportation, agriculture and rural areas when examining and approving the report of ecological environment impact and the report form of ecological environment impact involving navigation and fishery waters. Article
28 The people's governments at the municipal and county levels with districts shall organize the investigation and regulation of sewage outlets into rivers and lakes and substandard water bodies, and formulate and implement plans for substandard water bodies to meet the standards within a time limit. The people's governments of cities and counties
with districts shall take measures to eliminate black and odorous water bodies in urban built-up areas within the time limit prescribed by the state and provinces. Article
29 The following acts of discharging water pollutants are prohibited:
(1) Using seepage wells, seepage pits, fissures, karst caves, privately setting up underground pipes, tampering with or forging monitoring data, or abnormal operation of water pollution prevention and control facilities to evade supervision;
(2) Diluting the waste water before discharge;
(3) Discharging the waste water through rainwater pipes after the separation of rainwater and sewage pipes;
(4) Transferring the waste water from the factory by means of tank cars, water storage tanks or other means of transport or containers and dumping it illegally;
(5) Unauthorized alteration of sewage treatment methods and discharge of sewage without approval;
(6) Other prohibited acts prescribed by laws and regulations. Article
30 Urban sewage in the Chaohu Lake Basin shall be treated centrally. People's governments at or above
the county level shall organize departments of housing, urban and rural construction, development and reform, ecological environment and water administration to draw up plans for the construction of sewage treatment facilities in their respective administrative areas. The urban and rural housing construction departments of the people's governments at or above
the county level shall, in accordance with the construction plan of sewage treatment facilities, organize the construction of centralized sewage treatment facilities and supporting pipeline networks, and strengthen the supervision and management of the operation units of centralized sewage treatment facilities. Phosphorus and nitrogen removal facilities shall be constructed simultaneously with the
construction of new urban sewage centralized treatment facilities; if the existing urban sewage centralized treatment facilities do not have phosphorus and nitrogen removal facilities, they shall be added within a time limit, and the specific time limit shall be determined by the competent department of ecological environment of the provincial people's government. If all kinds of industrial parks
in Chaohu Lake Basin are not equipped with centralized sewage treatment facilities, the competent department of ecological environment shall not examine and approve the ecological environmental impact report and the ecological environmental impact report form of the construction project in the park, and the construction unit shall not start construction. The discharge of major water pollutants from
urban sewage treatment plants and industrial sectors shall comply with the provisions of the Discharge Limits for Major Water Pollutants from Urban Sewage Treatment Plants and Industrial Sectors in the Chaohu Lake Basin. Article
31 Within the area covered by public drainage facilities in Hefei, drainage units and individuals shall discharge sewage into public drainage facilities in accordance with the relevant provisions of the State; in areas where rainwater and sewage are diverted, sewage shall not be discharged into rainwater pipe networks. In addition to the roof public roof rainwater drainage system, the balcony and terrace drainage pipes should be connected to the sewage pipe network.
In areas not covered by public drainage facilities, drainage households shall build their own sewage treatment facilities or drainage networks to connect to public drainage facilities. Where the
existing drainage facilities fail to implement the diversion of rainwater and sewage, the diversion transformation shall be carried out in accordance with the time limit and requirements stipulated by the urban drainage management department; the connecting pipe between the self-use drainage facilities and the public drainage facilities shall be constructed by the drainage households.The urban drainage management departments of the people's governments at all levels
in Hefei shall supervise and inspect the takeover situation, urge the drainage households to carry out the transformation of rain and sewage diversion, and prevent mixing and leakage. Other areas in
the Chaohu Lake Basin should take measures to promote the diversion of rainwater and sewage. Article
32 Operating units of urban sewage centralized treatment facilities shall, in accordance with the provisions of the State, provide paid services for sewage treatment to polluters, collect sewage treatment fees and ensure the normal operation of sewage centralized treatment facilities. If the funds for the normal operation of centralized sewage treatment facilities are insufficient, the local municipal and county people's governments shall make overall arrangements.
Sewage discharge units and individuals shall pay sewage treatment fees in accordance with the provisions of the state and the province. Sewage treatment fees shall be earmarked for special purposes. Article
33 The discharge of sewage into centralized urban sewage treatment facilities shall meet the national and local standards for the discharge of water pollutants and the water quality standards for sewage discharged into urban sewers. When an operating unit of a centralized
sewage treatment facility samples and tests the drainage of a pollutant discharging unit within the catchment area, the relevant pollutant discharging unit shall provide convenient conditions. If the operating unit of the centralized sewage treatment facility finds that the quality of the discharged water exceeds the discharge standard, it shall promptly inform the discharging unit and report to the local competent department of ecological environment. Article
34 The key sewage discharge units in the Chaohu Lake Basin and the operating units of centralized urban sewage treatment facilities shall install and use automatic monitoring equipment for water pollutant discharge in accordance with the relevant provisions and monitoring norms of the State to ensure its normal operation, and shall be networked with the monitoring equipment of the competent department of ecological environment. The original monitoring records of pollutants shall be kept properly. Article
35 Municipal solid waste shall be classified, collected, transported and treated in accordance with the requirements. If
it is really necessary to build a landfill site for domestic waste, measures such as leakage prevention shall be taken in accordance with the technical specifications prescribed by the State. The leachate from domestic waste landfills shall be discharged up to the standard. Article
36 People's governments at or above the county level and their relevant departments shall strengthen the comprehensive improvement of rural environment, build facilities for the collection and treatment of rural domestic waste and sewage, promote the in-situ classification, resource utilization and treatment of rural waste, and establish a network system for the collection, transformation and utilization of rural organic waste. Article
37 People's governments at or above the county level shall promote advanced and applicable agricultural production technologies such as soil testing and formula fertilization, precision fertilization, green provention and control of pests and diseases instead of chemical control, organize and implement measures to reduce and replace chemical fertilizers and pesticides, promote zero growth in the use of chemical fertilizers and pesticides, adjust the structure of agricultural industry and develop them. We will carry out the construction of clean small watersheds and effectively control agricultural non-point source pollution. Article
38 The competent department of ecological environment shall, in conjunction with the agricultural and rural departments, formulate a plan for pollution prevention and control of livestock and poultry breeding, clarify the objectives and tasks of pollution prevention and control of livestock and poultry breeding, and support the standardized transformation of livestock and poultry farms and breeding communities and the construction and transformation of pollution prevention and control facilities.
Livestock and poultry farms and farming communities shall, in accordance with the scale of farming and the needs of pollution prevention and control, construct corresponding facilities for the diversion of livestock and poultry manure, sewage and rainwater, and storage facilities for livestock and poultry manure and sewage. 39 The relevant departments of the people's governments at or above the county level shall, in accordance with the relevant provisions of the state and provinces, rationally plan development and utilization of aquatic resources, popularize standardized aquaculture technology, scientifically determine the scope, scale, variety, density and mode of aquaculture in the river basin, and prevent and reduce the pollution of aquaculture to the water environment. Units and individuals
engaged in aquaculture shall use baits and medicines scientifically and rationally to prevent water environmental pollution and ecological damage. Article
40 The development and utilization of water tourism, water sports and water management in Chaohu Lake shall not pollute the water quality. Before approval, the relevant departments shall seek the opinions of the Chaohu Administration. Article
41 The people's governments at the municipal and county levels with districts shall make overall plans for the construction of facilities for receiving, transferring and disposing of ship pollutants and wastes at ports, wharfs, loading and unloading stations and ship repair plants.
Ports, wharves, loading and unloading stations and ship repair factories shall be equipped with sufficient facilities for receiving pollutants and wastes from ships. Units engaged in the reception of pollutants and wastes from ships, or in the cleaning of cabins carrying oil and polluting hazardous goods, shall have the capacity to receive and treat them in accordance with their scale of operation. Ships
entering the lake shall be equipped with sewage storage devices, oil collection or oil-water separation devices, and shall not dump ship garbage or discharge ship residual oil or waste oil into the water body. Article
42 Hazardous waste liquids produced by laboratories, laboratories and laboratories of schools, scientific research institutes and medical institutions shall be collected separately and disposed of safely in accordance with the relevant provisions of the state and provinces. Article
43 Units that store liquid chemical raw materials, oils and other underground engineering facilities shall take effective measures to prevent leakage. Activities that may interfere with underground aquifers, such as
underground exploration, mining, engineering drainage, development and utilization of underground space and underground hot water resources, shall take protective measures to prevent groundwater pollution. Chapter
IV Ecological Control
Article 44 People's governments at or above the county level shall strengthen the protection and restoration of the ecological functions of river basins, strengthen water and soil conservation and water conservation, and build ecological protection zones and isolation zones. Ecological treatment methods such as forest and wetland construction, ecological dredging and pond interception were adopted to reduce the total amount of pollutants entering the lake. The regulation of water resources in the
river basin should maintain the reasonable flow of surface water and maintain the natural purification capacity and ecological function of the water body. Article
45 The provincial people's government shall scientifically plan and construct water diversion projects, speed up the water exchange of Chaohu Lake and improve the water environment of Chaohu Lake. Article
46 People's governments at or above the county level shall organize relevant departments to formulate and implement wetland protection plans, strengthen the protection and restoration of wetland ecosystems, build a complete Chaohu cascade wetland system, restore aquatic vegetation, and enhance the ability of wetlands to conserve water sources and purify water quality.
The Hefei Municipal People's Government should make overall plans to determine the layout of ecological construction around Chaohu Lake, carry out the construction of ecological wetlands at the estuary of the lake, construct ecological wetlands around Chaohu Lake according to local conditions, and construct lakeside buffer zones. Article
47 In the development and construction activities in the Chaohu Lake Basin, effective measures shall be taken to maintain the ecological environment functions of the Chaohu Lake Basin and strictly abide by the red line of ecological protection. Engineering construction and land development
in the Chaohu Lake Basin should not occupy or occupy less wetlands. If it is really necessary to occupy a wetland, the natural resources department of the municipal or county people's government shall solicit the opinions of the forestry department at the same level before going through the relevant approval formalities; if it is necessary to occupy an important wetland, the natural resources department of the provincial people's government shall solicit the opinions of the forestry department at the same level. Those who need to occupy wetlands
due to emergencies such as flood control and emergency rescue shall be implemented in accordance with relevant laws and administrative regulations.Article
48 Whoever engages in production and operation activities within the scope of wetland protection in the Chaohu Lake Basin shall conform to the wetland protection plan, be compatible with the carrying capacity and environmental capacity of wetland resources, shall not destroy the basic functions of wetland ecosystems, shall not exceed the regenerative capacity of wetland biological resources, and shall not destroy the habitat and growth environment of wildlife. Article
49 People's governments at or above the county level shall promote the control and restoration of phosphorus-rich mountains, and take measures such as soil covering, soil and water conservation, and rainwater collection to control the input of phosphorus from phosphorus-rich strata to Chaohu Lake and its tributaries. Article
50 People's governments at or above the county level shall encourage and support research on the occurrence mechanism and formation conditions of cyanobacteria in Chaohu Lake, develop and apply cyanobacteria prevention and control technologies, and reduce the eutrophication of Chaohu Lake. Article
51 The Provincial Chaohu Administration shall strengthen the monitoring of cyanobacteria in Chaohu Lake and report the monitoring results to the competent department of ecological environment of the Provincial People's Government. The competent department of ecological environment of
the provincial people's government shall be responsible for the early warning and forecast of cyanobacteria in Chaohu Lake; if any abnormality is found, it shall be reported to the provincial people's government in time, and the local people's government concerned shall be notified. The local people's government should improve the emergency disposal plan for provention and control of cyanobacteria blooms, organize timely salvage of cyanobacteria in Chaohu Lake, and carry out harmless treatment to reduce the impact of cyanobacteria on the environmental quality of Chaohu Lake. Article
52 People's governments at or above the county level shall, in accordance with the provisions of the State, carry out compulsory liability insurance for environmental pollution and emission trading, implement preferential policies on sewage treatment, harmless treatment of sludge and collection and treatment of garbage, and implement economic policies conducive to the protection of the ecological environment. Chapter
V Legal Liability
Article 53 If the people's governments at all levels and the departments and institutions responsible for the supervision and management of ecological environment protection of the people's governments at or above the county level violate the provisions of these Regulations and commit one of the following acts, the directly responsible persons in charge and other directly responsible persons shall be given a demerit, a major demerit or a demotion; Those who cause serious consequences shall be punished by removal from office or dismissal, and their principal responsible persons shall take the blame and resign; those who constitute crimes shall be investigated for criminal responsibility according to law:
(1) failing to meet the total discharge control targets for key water pollutants;
(2) examining and approving development and utilization plans and construction projects in violation of laws and regulations;
(3) failing to plan and set up water environment quality monitoring points;
(4) failing to publish water environment quality information in accordance with regulations;
(5) failing to eliminate backward technology and equipment that seriously pollute the environment within a time limit;
(6) Enterprises and institutions that seriously pollute the water environment shall be ordered to close down or stop production according to law, but they have not made such a decision, or other administrative penalties have not been imposed in accordance with the provisions;
(7) Failing to perform the duties of supervision and inspection, such as failing to investigate and deal with environmental violations in time after discovering them or receiving reports of environmental violations;
(8) Failing to supervise and inspect the diversion and takeover of rain and sewage, resulting in mixed or missed connection;
(Nine) other illegal acts stipulated by laws and regulations. Article
54 Whoever, in violation of the provisions of Item 3 of Paragraph 1 of Article 23 of these Regulations, sells phosphorus-containing detergents in the first, second and third-level water environment protection zones shall be ordered by the market supervision department of the people's government at or above the county level to make corrections within a time limit and shall be fined 20000 yuan. Whoever,
in violation of the provisions of Item 4 of Paragraph 1 of Article 23 of these Regulations, reclaims land from lakes in the first, second and third-level water environment protection zones shall be ordered by the water administration department of the people's government at or above the county level to stop the illegal act, restore the original state or take other remedial measures, and may be fined not less than 10000 yuan but not more than 50000 yuan; If neither the original state nor other remedial measures are taken, the original state shall be restored or other remedial measures shall be taken instead, and the expenses required shall be borne by the offender. Article
55 Whoever commits any of the following acts shall be ordered by the people's government at or above the county level to dismantle or close down:
(1) In violation of the provisions of Items 1 and 2 of Paragraph 1 of Article 23 of these Regulations, a new chemical pulp and paper enterprise is established in the first, second and third-level water environment protection zones. Or build new small-scale projects with serious water pollution such as tanning, chemical industry, printing and dyeing, electroplating, brewing, cement, asbestos and glass in the three-level water environment protection zone;
(2) In violation of the provisions of the second paragraph of Article 23 of these Regulations, large and medium-sized projects with serious water pollution, such as leather making, chemical industry, printing and dyeing, electroplating, brewing, cement, asbestos and glass, are built in the three-level water environment protection zones without consent;
(3) Violating the provisions of Item 1 of Article 24 of these Regulations, building or expanding projects with serious water pollution, such as tanning, chemical industry, printing and dyeing, electroplating, brewing, cement, asbestos and glass, in the first and second-level water environment protection zones. Article
56 Whoever, in violation of the first item of the first paragraph of Article 25 of these Regulations, builds or expands a construction project for discharging water pollutants in a first-level water environment protection zone shall be ordered by the Chaohu Lake Administration to stop the illegal act and to impose a fine of 500,000 yuan; and shall be ordered to dismantle or close it with the approval of the people's government with the power of approval. Whoever,
in violation of the provisions of Item 4 of Paragraph 1 of Article 25 of these Regulations, engages in enclosure and cage aquaculture in the first-level water environment protection zones shall be ordered by the Chaohu Lake Administration to stop the illegal activities, take control measures within a time limit to eliminate pollution, and shall be fined not less than 20000 yuan but not more than 100000 yuan. Whoever,
in violation of the provisions of Item 5 of Paragraph 1 of Article 25 of these Regulations, establishes a livestock and poultry farm in a first-level water environment protection zone shall be ordered by the people's government at or above the county level to dismantle or close it. Whoever,
in violation of the provisions of Item 6 of Paragraph 1 of Article 25 of these Regulations, engages in aquatic catering business in the first-level water environment protection zone shall be ordered by the Chaohu Lake Administration to stop the operation, or put forward suggestions for handling it, and shall be handed over to the local people's government at or above the county level for demolition or closure. Article
57 If, in violation of the provisions of the first paragraph of Article 31 of these Regulations, drainage units and individuals in the areas covered by public drainage facilities in Hefei fail to discharge sewage into public drainage facilities in accordance with the relevant provisions of the State, or discharge sewage into rainwater pipe networks in areas where rainwater and sewage are diverted, the urban administrative department shall order them to make corrections and give warnings; Those who fail to make corrections within the time limit or cause serious consequences shall be fined not less than 100,000 yuan but not more than 200,000 yuan for units, and not less than 20,000 yuan but not more than 100,000 yuan for individuals; those who cause losses shall be liable for compensation according to law. Chapter
VI Supplementary Provisions
Article 58 These Regulations shall come into force on March 1, 2020.
