Atlas said it believed that Trina Solar's two patents involved in litigation should be invalid , and its products and processes did not infringe Trina Solar's two patents. For the two patents involved in the lawsuit, Changshu Atlas has formally submitted a request for patent invalidation to the State Patent Office of China in August 2024 and November 2024, respectively, and both requests are currently under trial.
According to the announcement of Atlas, one of the patents involved in this case is the same patent as Trina Solar's request for customs seizure of photovoltaic products shipped to Europe by Atlas in May 2024 for patent infringement.
Atlas said in the announcement that Trina Solar had not filed a lawsuit in court since it applied for customs detention in May 2024. In November 2024, Changshu Atlas submitted to the Intermediate People's Court of Suzhou a lawsuit concerning the non-infringement of two patents involved in the lawsuit. The Suzhou Intermediate People's Court accepted the case in December 2024 and set the time for the first hearing.
In addition, in October 2024, Atlas filed a lawsuit against Trina Solar with the Suzhou Intermediate People's Court on the grounds of infringement of its two patents, with the case numbers of (2024) Su 05 Min Chu No.1385 and (2024) Su 05 Min Chu No.1399. Atlas demanded that Trina Solar stop infringement and compensate it for a total of 100 million yuan . The two cases are still ongoing.
