Green mine construction is an important measure to promote the high-quality development of mining industry, a powerful starting point for the construction of ecological civilization in the field of mining industry, and an inevitable requirement for the realization of harmonious coexistence between man and nature. In order to speed up the green and low-carbon transformation and development of mining industry and comprehensively promote the construction of green mines, the relevant matters are hereby notified as follows.

On April 16, the Ministry of Natural Resources, the Ministry of Ecology and Environment, the Ministry of Finance, the State Administration of Market Supervision and Administration, the State Administration of Financial Supervision and Administration, the China Securities Regulatory Commission and the State Forestry and Grassland Administration jointly issued a circular on further strengthening the construction of green mines. The circular pointed out that by the end of 2028, the working mechanism of green mine construction will be more perfect, and 90% of large mines and 80% of medium-sized mines with certificates in production will meet the requirements of green mine standards.

I. General Requirements

(I) Guiding Ideology.". Guided

by Xi Jinping's socialist ideology with Chinese characteristics in the new era, we should thoroughly implement the spirit of the 20th National Congress of the Communist Party of China, comprehensively implement Xi Jinping's thought of ecological civilization, completely, accurately and comprehensively implement the new development concept, construct a new development pattern, promote high-quality development, firmly establish and practice the idea that green mountains are Jinshan and Yinshan. Correctly handle the relationship between high-quality development and high-level protection, plan the green and low-carbon development of mining industry from the perspective of harmonious coexistence between man and nature, and run the concept of green development through the whole process of mineral resources exploration and development through government guidance, department cooperation, enterprise construction and social supervision, so as to effectively improve the level of mineral resources development, utilization and protection, and help build a beautiful China.

(2) Basic principles.

Insist on classified measures and push forward in an all-round way. Based on the actual development of mining industry, all localities should scientifically and rationally set the road map and timetable for the construction of green mines, strengthen planning and control, promote source management and systematic management, and promote the construction of green mines in all newly built, rebuilt and expanded mines (with legal and effective licenses, normal production in the past three years, and the remaining reserves can be mined for no less than three years).

Insist on innovation-driven, transformation and upgrading. Give full play to the leading role of innovation, accelerate technological innovation and equipment upgrading and transformation in the mining industry, focus on promoting breakthroughs in key technologies, and accelerate the development and wide application of new green and low-carbon technologies, new processes and new equipment.

Insist on coordinated supervision and dynamic management. Strengthen coordination and linkage among relevant departments, jointly manage the daily supervision of green mines, strengthen the dynamic management of national and provincial green mine lists, and do not set up municipal and county green mine lists. After evaluation, the established green mines at the municipal and county levels are selected to be included in the list of provincial green mines, and the green mines are urged to continuously improve their construction level.

(3) Main objectives.

By the end of 2028, the working mechanism of green mine construction will be more perfect, 90% of large mines and 80% of medium-sized mines with certificates in production will meet the requirements of green mine standards, and all localities can strengthen the management of small mines according to green mine standards.

2. Promoting the construction

of green mines in an all-round way (4) Compacting the main responsibility of mining enterprises. Mining enterprises engaged in mineral resources development according to law are the main body responsible for the establishment of green mines. They should firmly establish and practice the concept that green water and green hills are Jinshan and Yinshan, strictly follow the standards and norms, and control the disturbance of the ecological environment in the mining area and its surrounding areas within a controllable range in the whole process of mineral resources development. To build a green mine with ecological environment, scientific mining methods, efficient utilization of resources, standardized enterprise management and harmonious community in the mining area. Mining enterprises should implement plans for mine development and utilization, ecological restoration and environmental protection, clarify the tasks and progress of green mine construction, implement the requirements of "mining while restoring" and make them public to the public in a timely manner. Mines mined in accordance with the law within the red line of ecological protection and outside the core protected areas of nature reserves should implement the most stringent standards and norms, strictly implement the relevant requirements of green mining and ecological restoration of mine environment, and comprehensively take measures to mitigate the impact of ecological environment and nature reserves. Establish a complaint response mechanism, smooth communication and interaction with stakeholders such as communities affected by mines, take the initiative to accept social supervision, and establish a good corporate image.

(5) Promoting the construction of green mines in an orderly and classified manner. The competent departments of natural resources, in conjunction with the relevant departments, shall, in accordance with the provisions of laws, regulations or the policy documents of the Party Central Committee and the State Council on the construction of green mines, specify the requirements for the construction and operation of new mines in strict accordance with the standards for green mines, and shall pass the assessment and verification of green mines within 1-2 years after the formal commissioning of the mines. When the mining right is transferred, the relevant requirements and liabilities for breach of contract shall be included in the transfer contract. In order to speed up the green upgrading and transformation of production mines, the time limit and requirements for the construction of green mines should be clearly defined when going through the formalities of continuation and alteration. Local departments in charge of natural resources are encouraged to sign green mine construction contracts with mining enterprises. For production mines with less than three years of remaining reserves, it is required to strengthen management in accordance with the green mine construction standards, focusing on pollution prevention and control before pit closure, as well as ecological restoration work such as mine geo logical environment restoration, land reclamation and vegetation restoration.

(6) Accelerate the application of green low-carbon advanced and applicable technologies. Mining enterprises should strengthen the upgrading and transformation of green low-carbon technology and equipment, and encourage the adoption of technologies in the Catalogue of National Key Promotion of Low-carbon Technologies and the Catalogue of Advanced and Applicable Technologies for Mineral Resources Conservation and Comprehensive Utilization in the links of resource development, comprehensive utilization, energy conservation and emission reduction, and ecological restoration, so as to promote the green and low-carbon transformation of mines. Accelerate the integration of 5G, big data, Internet, artificial intelligence and other information technologies, promote the digital, intelligent and green development of mining enterprises, and improve the efficiency of resource development and utilization and production management.

(7) Continuously improve the establishment level of mining enterprises. Mining enterprises should take the initiative to conduct regular self-evaluation according to the corresponding industry standards and evaluation indicators, carry out the establishment of green mines as planned, find problems and shortcomings in time, and actively promote rectification. If the task of green mine construction is completed and the self-assessment meets the standard requirements, the self-assessment report may be submitted to the competent department of natural resources to declare the provincial green mine. The mining enterprise shall be responsible for the authenticity of the self-assessment report.

3. Strengthen the management

of third-party evaluation (8) Strict third-party evaluation. The competent department of natural resources shall, in conjunction with the relevant departments, conduct a preliminary examination of the application materials of mining enterprises. If the preliminary examination is qualified, the competent department of natural resources at the provincial level shall entrust a third-party evaluation agency to carry out on-site verification and evaluation. The competent departments of natural resources of provinces

(districts and municipalities) jointly with relevant departments to strengthen the standardized management of third-party assessment. Third-party evaluation institutions should be enterprises, institutions and trade associations with independent legal personality, and have the business ability to carry out green mine construction evaluation. The appraisers shall be familiar with the relevant policies and standards of green mines, covering geology, mining, mineral processing, ecology, environment and other specialties, and be able to carry out long-term and stable appraisal work (see Annex 1 for specific work requirements). Third-party evaluation institutions should strictly follow the green mine construction standards and evaluation indicators, compile and form third-party evaluation reports with verification records and image data, strictly prohibit the collection of evaluation fees from mining enterprises, sign authenticity commitments, and ensure the fairness and impartiality of the results.

4. Dynamic management of the list of

green mines (9) Selecting the best to be included in the national list of green mines. The competent departments of natural resources of all provinces (autonomous regions and municipalities), together with relevant departments, regularly or irregularly carry out spot checks and verifications on mining enterprises that have passed the third-party assessment, and publicize them to the public after confirmation. If there is no objection to the publicity, they shall be included in the list of provincial green mines according to the procedures. National green mines are recommended from provincial green mines in accordance with relevant requirements, and the Ministry of Natural Resources, together with relevant departments, determines national green mines through expert demonstration, spot check and verification, and public announcement, which are included in the list of national green mines and made public to the public.

(10) Implementing dynamic management. The list of green mines shall be managed dynamically (see Annex 2 for specific requirements), and the mines that do not meet the standards in the list shall be removed in time according to the procedures, so as to urge green mining enterprises to continuously consolidate their construction achievements and continuously improve their construction level.

5. Increase policy support

(11) Actively implement preferential tax policies. We will implement preferential tax policies for high-tech enterprises, environmental protection, energy and water conservation, and comprehensive utilization of resources.

(12) Policies to encourage innovation and support. Local governments should explore and improve incentive and restraint policies for green mine construction, and increase policy support for land use, mining and finance. Green mining enterprises shall be supported in accordance with the law and regulations when transferring and integrating mining rights and handling procedures for construction land, forest and grass use. Mining rights that conform to the agreement transfer are allowed to be transferred to green mines in the form of agreement transfer.

We will promote the listing of qualified green mining enterprises on the Shanghai, Shenzhen and Beijing Stock Exchange, as well as on the new third board and regional equity markets. Banking financial institutions are

encouraged to develop green mining characteristic credit products in line with regional reality on the premise of strengthening environmental, safety, social and governance risk assessment and management of investment projects in the mining sector, and to increase financial support for green mining enterprises under the principles of risk control and business sustainability.

6. Further improve the standard system

(13) Improve industry standards and evaluation indicators. We will improve the standard system for the construction of green mines and study and formulate industry standards for the construction of green mines such as open-pit mines and geothermal mineral water. Improve the national green mine construction evaluation indicators (see Annex 3), including binding indicators and promotion indicators, binding indicators for the bottom line requirements. Relevant evaluation indicators should be adjusted in time according to the changes of laws, regulations and technical standards.

(Fourteen) encourage the formulation and revision of local standards and enterprise standards. Local standards can be revised according to the actual situation, taking into account regional, mineral, scale, mining methods and other factors, or the evaluation index requirements of provincial green mines can be refined and clarified. Encourage qualified mining groups and enterprises to actively develop enterprise standards and apply them in practice.

7. Improve the working mechanism

(15) Form a joint effort of joint management. The Ministry of Natural Resources, together with the Ministry of Ecology and Environment, the Ministry of Finance, the General Administration of Market Supervision, the General Administration of Financial Supervision, the China Securities Regulatory Commission and the State Forestry and Grass Administration, jointly promotes the construction of green mines, and closely cooperates with each other in accordance with the division of responsibilities to form a joint effort. All departments should improve the communication and coordination mechanism, strengthen the dynamic supervision of green mines, and timely inform relevant information. If violations of laws and regulations are found, they shall be handed over to the functional departments in time for handling according to law. Relevant departments collect the information of administrative penalties related to enterprises into the national enterprise credit information publicity system, record it under the name of enterprises and publicize it to the society. The competent department of

natural resources is responsible for the supervision of the "three rates" of mines (mining recovery rate, mineral processing recovery rate, comprehensive utilization rate), the implementation of mine geological environmental protection and land reclamation schemes. The competent department of

ecological environment is responsible for the supervision of mine ecological environment and pollution prevention and control.

The financial department is responsible for the funding guarantee for the assessment and identification of green mines.

The market supervision department is responsible for coordinating and guiding the formulation and revision of national and industrial standards for green mine construction.

Financial supervision departments are responsible for formulating and improving green financial policies to support the green development of mining enterprises. The competent

securities regulatory authorities are responsible for supporting the listing and financing of qualified green mining enterprises in China.

The forestry and grass department is responsible for the formalities for the occupation of forest land and grassland by mines, the restoration of vegetation after the expiration of temporary occupation of forest land, and the supervision of the restoration of vegetation after the expiration of temporary occupation of grassland by ancillary projects of mine development.

Other relevant departments should carry out relevant work according to their own functions and responsibilities and in accordance with the requirements of green mine construction.

8. Strengthen supervision and assessment

(16) Strengthen supervision, verification, assessment and evaluation. The departments in charge of natural resources at all levels, together with the relevant departments, shall strengthen the supervision of the mines that have not yet been established, and promote the construction of green mines as soon as possible. In strict accordance with the requirements of "double random and one open", no less than 10% of the green mines shall be selected into the random inspection list every year, and the on-site verification of the national green mines shall be carried out in strict accordance with the new evaluation indicators. All localities should incorporate the construction of green mines into the government performance appraisal system and the evaluation index system of the outgoing audit of natural resources assets of leading cadres, and promote the evaluation and assessment of the construction of green mines in combination with the actual situation.

(17) Strictly implement management requirements. Third-party assessment agencies and assessors who have been verified to have committed irregularities such as transferring or outsourcing the assessment work undertaken, leaking the secrets of mining enterprises, colluding with enterprises to falsify, and seriously inaccurate assessment conclusions shall be notified and blacklisted, and their green mine assessment services shall not be accepted within three years.

Strict dynamic management of the list of green mines, do a good job of linking up the old and new evaluation indicators, and find that one of the following problems exists in green mines, remove them from the list in time according to the procedures: "Mining License", "Safety Production License" and "Business License" are not complete, expired and not extended in time or revoked; The enterprise fails to implement the administrative penalty within the performance period; the enterprise is closed, stops production due to its own reasons and fails to operate normally; illegal mining, especially cross-border mining, changes the mining method without authorization; major or more safety production accidents or environmental incidents occur, and serious pollution of soil and groundwater occurs; Failing to implement the requirements of relevant systems such as environmental impact assessment and pollutant discharge permit, and failing to rectify on schedule; failing to regularly carry out the investigation of potential pollution hazards of the tailings reservoir as required or failing to construct and operate the pollution prevention and control facilities of the tailings reservoir as required; being included in the list of anomalies in the public announcement of exploration and mining information of the mining right holder; and the level of mineral resources development and utilization is classified as backward; Those who have been reported as typical cases or included in various warning films by the central environmental protection supervision, inspection and audit, and law enforcement inspection of the Standing Committee of the National People's Congress; those who have caused negative public opinion on the national portal websites and platforms due to the occurrence of emergencies and violations of laws and regulations by enterprises; those who have fraudulently passed the green mine assessment; and those who have other violations of laws and regulations that should not continue to be included in the list.
